PC -30 Page 3 September 18, 2012 <br />Comm. 706: <br />(Bill 255) <br />Comm. 706.1: <br />ADJOURNMENT <br />AMENDS ORDINANCE NO. 08 -150 WHICH AMENDED ORDINANCE NO. 465, WHICH <br />RECLASSIFIED LANDS FROM AGRICULTURAL — 1 ACRE (A -1A) TO NEIGHBORHOOD <br />COMMERCIAL — 7,500 SQUARE FEET (CN -7.5)) AT KEALAKEKUA, SOUTH KONA, <br />HAWAII, COVERED BY TAX MAP KEY 8 -2 -013: PORTION OF 002 <br />Amends Ordinance No. 08 -150 by eliminating Condition E, which limits use of property to a <br />visitor center and related and accessory uses of a visitor center in substantial conformance to the <br />description in the current application for reasons of public health, safety, and welfare due to flood <br />hazards in the area. <br />Intr. by: Ms. Ford <br />Referred to Planning Director May 16, 2012 <br />;and <br />From Mayor William P. Kenoi, dated August 22, 2012, submitting enclosures with a favorable <br />recommendation from the Leeward Planning Commission Vice Chair Lani Bowman with <br />inclusion of the following modification from the Planning Director: replacing the current <br />Condition E in its entirety by adding road improvements along the entire southeast frontage of the <br />property, consisting of an intersection with Mamalahoa Highway, a 20 -foot wide paved lane and <br />concrete curb, gutter, and sidewalk, drainage improvements, and any relocation of utilities <br />required by Department of Public Works (DPW), and allowing a bi- weekly farmers' limited to the <br />sale of local fresh or raw produce, plant life, fish, and homegrown or homemade products. Also <br />adding a new Condition F requiring a Traffic Impact Analysis Report should the applicants, <br />successors, or assigns develop a land use which generates over 50 peak hour trips; and implement <br />when required by DPW any transportation system improvements that may be deemed necessary. <br />In conclusion it recommends that Condition L regarding fair share contributions be updated to <br />current rates. <br />The meeting places are accessible for persons with disabilities.
