WHEREAS, the subject road and drainage improvements have been completed according to <br /> County of Hawai`i standards, and are in acceptable condition for dedication, and in full compliance <br /> with the provisions of Chapter 23 of the Hawai`i County Code; and <br /> WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving <br /> by dedication any streets in any subdivision platted after December 2, 1966 except upon full <br /> compliance with the provisions of Chapter 23; and <br /> WHEREAS, Section 23-41 of the Hawaii County Code prohibits the Council from receiving <br /> by dedication any streets that are less than the minimum right-of-way and pavement widths; and <br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the <br /> council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the <br /> subject roadway lots are in full compliance with the provisions of Chapter 23 of the Hawaii County <br /> Code as certified and approved by all applicable agencies, and that it is in the public interest to accept <br /> such dedication. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in <br /> accordance with Article XIII, Section 13-12 of the Hawai`i County Charter, and Sections 23-10 and <br /> 23-41 of the Hawai`i County Code, that the County of Hawaii accepts the dedication of Road Lots <br /> 10-A, 1-B and 3-A-2, portions of which contains an area of 7.868 acres, 0.081 acre and 0.066 acre, <br /> more or less, respectively, identified as a portion of Tax Map Keys: (3) 8-1-035:004 (por.) (Lot 10-A), <br /> (3) 8-1-035:001 (por.) (Lot 1-B) and (3) 8-1-036:001 (por.) (Lot 3-A-2) and, delineated on Exhibit "A" <br /> attached hereto for public road and drainage purposes. <br /> BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) the <br /> Honorable William P. Kenoi, Mayor of the County of Hawaii; (2) the Department of Public Works; <br /> 2 <br />
