Land Use Rural District. This request was ultimately approved by the <br />State Land Use Commission on June 10, 2008. <br />While the reclassification request was being considered, the applicant <br />requested further amendments to Ordinance No. 05 157 relating to the <br />nature of the traffic improvements at the intersection of Waikoloa Road <br />and Pua Melia Street/Paniolo Drive and allowing another access to the <br />subject project. Relative to the intersectional improvements, at the <br />request of the councilmember and a number of residents of the Waikoloa <br />community, the applicant requested that the improvements be changed <br />from a traffic signal to a roundabout system. <br />Although the requests were approved and became effective on September <br />28, 2007, additional conditions were imposed. One of these required <br />securing final subdivision approval within five (5) from the effective date of <br />the amendment with no allowance for an administrative time extension <br />and not ten (10) years or March 2015 deadline as originally allowed by the <br />former ordinance. A copy of this ordinance (Ordinance No. 07 127) is <br />found in Exhibit B. <br />11. NATURE OF REQUEST <br />Given current market conditions and projected absorption rate, it does not <br />appear feasible to have the entire proposed subdivision completed within <br />a 5 -year period. It has and continues to be the applicant's plan to develop <br />the project in at least eight (8) increments. <br />Accordingly, the applicant requests a five year extension to complete the <br />first increment consisting of a minimum of 50 Tots within five years of the <br />effective date of this amendment, with a 10 -year completion date of the <br />entire project. As such, the suggested language to Condition B could <br />read as follows: <br />"Final Subdivision approval for not less than 50 lots shall be secured <br />within five (5) years of this new amendment, provided, however, that <br />Final Subdivision approval for the entire project shall be secured within ten <br />(10) years of this new amendment." <br />11I. PROJECT LOCATION <br />The subject area, consisting of 731.579 acre's, is located on the south side <br />of Waikoloa Road near its intersection with Paniolo Avenue. The <br />Waikoloa Stables is located directly across and north of the subject site. <br />(Figure 1) <br />2 <br />
