/ ± .. <br /> COUNTY OF HAWAII ''�'&:•I' STATE OF HAWAI'I <br /> rf�pi'MA _ <br /> RESOLUTION NO. 79 13 <br /> A RESOLUTION AUTHORIZING THE EXTENSION OF THE PUBLIC SEWER FROM <br /> THE MANAWALE'A STREET / ANE KEOHOKALOLE HIGHWAY INTERSECTION <br /> THRU THE PROPOSED MANAWALE'A AND KA'EKA STREETS WITHIN TAX MAP <br /> KEYS 7-4-021:026 AND 7-4-021:044 FOR PHASE 1A OF THE KAMAKANA <br /> VILLAGES, SITUATED IN KEALAKEHE AND KEAHUOLU, NORTH KONA, <br /> HAWAI'I, FOR FOREST CITY HAWAI'I KONA,LLC <br /> WHEREAS, applicant Forest City Hawai'i Kona, LLC has requested to extend the sewer <br /> in accordance with Section 21-26, Hawai'i County Code within Tax Map Keys 7-4-021:026 and <br /> 7-4-021:044 to service parcels 7-4-021:035, 7-4-021:036, 7-4-021:037, 7-4-021:038, 7-4- <br /> 021:039, and 7-4-021:040, which is owned by FHT Kamakana LLC for development of the <br /> Kamakana Villages Phase 1A subdivision; and <br /> WHEREAS, applicant Forest City Hawai'i Kona, LLC will construct and bear the full <br /> cost of the extension and will be eligible to exercise conditions under Section 21-28(a), Hawai'i <br /> County Code, granting reimbursement to the applicant for 10 years after completion of the <br /> extension of one-half of all monies for sewer charges collected by the County from other <br /> properties connecting to the extension provided that the total of such reimbursement shall not <br /> exceed the cost incurred by the applicant to construct the extension; and <br /> WHEREAS, the subject extension and the roadway lots will be built to dedicable <br /> standards and dedicated to the County when completed, to be accepted by a separate resolution, <br /> upon recommendation of the appropriate County agencies; and <br /> WHEREAS, the Director of Environmental Management has recommended approval of <br /> the extension according to Section 21-27, Hawai'i County Code; and Attachment "A" is an <br /> application for sewer extension from Forest City Hawai'i Kona, LLC with a location map; and <br /> WHEREAS, sewer extensions are beneficial to the community by eliminating the need <br /> of alternative waste treatment options and reducing the amount of potential pollutants reaching <br /> the groundwater and the coastal waters,resulting in a cleaner, healthier environment; and <br /> WHEREAS, Section 21-26, Hawai'i County Code, requires that the Council approve all <br /> sewer extensions; now therefore, <br />
