4O;NtY OF h�'•'. <br /> • <br /> COUNTY OF HAWAII STATE OF HAWAII <br /> ' fit'•:rTM°,�•�� <br /> BILL NO. 83 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 11, DIVISION 1, SECTION 24-300 <br /> OF THE HAWAI`I COUNTY CODE 1983 (2005 EDITION, AS AMENDED), RELATING TO <br /> SPEED LIMITS. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br /> SECTION 1. The purpose of this measure is to establish speed limits in the Hawai`i County <br /> Code for the Hawaiian Paradise Park Subdivision so that speed limits can be properly enforced by the <br /> police. Pursuant to Section 24-2 of the Hawaii County Code, the County shall not be responsible for the <br /> maintenance and repair of any private street, highway, or thoroughfare when it imposes or enforces traffic <br /> regulations and highway safety laws on that private street, highway, or thoroughfare. <br /> SECTION 2. Chapter 24, Article 11, Division 1, Section 24-300, Schedule 4. 25 mile per <br /> hour limit, subsection (g), Puna, of the Hawai`i County Code 1983 (2005 Edition, as amended), to be <br /> amended by adding new item and renumbering as required: <br /> ( ) Hawaiian Paradise Park Subdivision, all paved roads except for Shower Drive, Kaloli <br /> Drive, Paradise Drive and Makuu Drive. <br /> SECTION 3. Material to be repealed is bracketed and stricken. New material is underscored. <br /> In printing this ordinance, the brackets, bracketed and stricken material and underscoring need not be <br /> included. <br /> SECTION 4. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or application. <br /> and to this end, the provisions of this ordinance are declared to be severable. <br />
