Correa Jr. Trust <br /> Agent: All Aina Services <br /> To Whom It May Concern: <br /> The owners of the subject property are requesting an extension of time of seven(7)years <br /> allowance for the completion of conditions"C"&"K". <br /> To address condition"C"as per Ordinance No. 05 110,Bill No. 92: <br /> C. Final Subdivision Approval of the proposed subdivision development shall be <br /> secured within five(5)years from the effective date of this amendment,July 13, 2005; <br /> • The partnership situation made moving forward within the required tiineframe <br /> impossible. However, with the lingering issues from the partnership resolved,and with <br /> the approval of the requested amendment;Mr. &Mrs. Correa intend to move forward. <br /> To address condition"K", as per Ordinance No. 05-110,Bill No. 92 <br /> K. The application shall make its fair share contribution to mitigate the potential <br /> regional impacts of the property with respect to parks and recreation, fire, police, solid <br /> waste disposal facilities,and roads. The fair share contribution shall be initially based on <br /> the representations within the change of zone application and may be increased or <br /> reduced proportionally if the lot counts are adjusted. The fair share contribution shall <br /> become due and payable prior to receipt of Final Plat Approval or within five years from <br /> the effective date of this amended change of zone ordinance, whichever occurs first. The <br /> fair share contribution for each lot shall be based on a maximum density for each lot, as <br /> determined by the zoning resulting from this change of zone. The fair share contribution <br /> in the form of cash, land, facilities, or any combination thereof shall be determined by the <br /> County Council. The fair share contribution may be adjusted annually beginning three <br /> years after the effective date of the amendment to the ordinance,based on the percentage <br /> change in the Honolulu Consumer Price Index(HCPI).
