the Mamalahoa Bypass Highway, at Ka`awaloa, in the District of South Kona, County and State <br /> of Hawai`i, to take, acquire and condemn the additional lands described as follows in: Exhibits <br /> "1," legal description, and"2,"parcel map, attached hereto and made a part hereof, for Parcel 22 <br /> consisting of 0.619 acre, more or less; Exhibits "3," legal description, and "4,"parcel map, <br /> attached hereto and made a part hereof, for Parcel 23 consisting of 2.303 acres, more or less; <br /> Exhibits "5," legal description, and"6,"parcel map, attached hereto and made a part hereof, for <br /> Parcel 24 consisting of 4.079 acres, more or less; Exhibits "7," legal description, and "8,"parcel <br /> map, attached hereto and made a part hereof, for Parcel 27 consisting of 0.200 acre, more or less; <br /> Exhibits "9," legal description, and "10,"parcel map, attached hereto and made a part hereof, for <br /> Parcel 28 consisting of 0.021 acre, more or less; and together with any adjacent lands necessary <br /> for temporary construction purposes, including but not limited to, temporary easements for <br /> construction and operations, storage and disposal areas. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that the Corporation Counsel of the County of Hawai`i be and is hereby authorized <br /> and empowered to initiate proceedings in eminent domain, as provided by law, for the taking, <br /> acquisition and condemnation of the aforesaid land. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that the process of said proceedings in eminent domain, the Corporation Counsel be <br /> and is hereby authorized and empowered to negotiate terms of settlement, subject to Section 2- <br /> 10, Hawai`i County Code, and the approval of the Court before which such proceedings are <br /> prosecuted. <br /> BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed to <br /> transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of <br /> 3 <br />
