STATE OF HAWAII <br /> �Of '''_' <br /> BILL NO. 189 <br /> ORDINANCE NO. <br /> AN ORDINANCE AMENDING CHAPTER 11,HAWAII COUNTY CODE 1983 (2005 EDITION, <br /> AS AMENDED),RELATING TO AFFORDABLE HOUSING POLICY. <br /> BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAII: <br /> SECTION 1. Chapter 11, article 1, section 11-8 of the Hawai`i County Code 1983 (2005 Edition, <br /> as amended) is amended to read as follows: <br /> Section 11-8. Density bonus. <br /> (a) Any project subject to an affordable housing requirement under this chapter that fulfills its <br /> housing requirement by constructing affordable dwelling units for sale or rent or by donating <br /> finished lots with infrastructure shall be entitled to a density bonus increasing the total number of <br /> residential units that may be constructed on the site by ten percent, and decreasing the minimum <br /> lot size by ten percent, compared to the number of units otherwise allowable and the minimum lot <br /> size as established by the zoning code. <br /> (b) If a project fulfills its affordable housing requirement off-site, the density bonus can be used on <br /> the non- affordable site, or the affordable housing site,or divided between the two sites. <br /> (c) The density bonus may not be used in the State Land Use Agricultural District or Rural Districts to <br /> create lots less than the minimum lot sizes required in those districts. <br /> SECTION 2. Material to be repealed is bracketed and stricken. New material is underscored. In <br /> printing this ordinance,the brackets, bracketed and stricken material, and underscoring need not be <br /> included. <br /> SECTION 3. Severability. If any provision of this ordinance or the application thereof to any <br /> person or circumstance is held invalid, such invalidity does not affect other provisions or application of <br /> the ordinance which can be given effect without the invalid provision or application, and to this end, the <br /> provisions of this ordinance are severable. <br /> SECTION 4.
