Police <br /> services are located nearby on Kapi`olani Street. Fire services are located in downtown <br /> Hilo. Medical services are available at Hilo Medical Center. Nearby parks include <br /> Lincoln Park and Mohouli Park. Private and public schools are in close proximity to the <br /> property. <br /> The request is not contrary to Chapter 205A, Hawaii Revised Statues, <br /> relating to Coastal Zone Management Area. The subject property is located over half <br /> a mile from the shoreline and is not in the Special Management Area. Thus, the property <br /> will not be affected by coastal hazards and beach erosion. There are no identified <br /> recreational resources, historic resources, public access to the shoreline or mountain <br /> areas, scenic and open space preserves, coastal ecosystems, marine resources or other <br /> natural and environmental resources on the subject property. <br /> In view of the Hawai`i State Supreme Court's "PASH" and "Ka Pa'akai 0 <br /> Ka Aina"decisions, the issue relative to native Hawaiian gathering and fishing rights <br /> must be addressed in terms of the cultural, historical, and natural resources and the <br /> associated traditional and customary practices of the site: <br /> • Investigation of valued resources: An archaeological survey was not conducted <br /> because the property has previously been graded and is developed with a single- <br /> family dwelling. A flora and fauna survey of the property was conducted by <br /> Geometrician Associates, LLC in June 2009. <br /> • The valued cultural,historical, and natural resources found in the rezoning area: <br /> The flora and fauna survey found no rare, threatened, or endangered floral or <br /> faunal species on the property,but recommended against removing or disturbing <br /> any vegetation during the months of June and July in order to avoid impacts to <br /> any roosting endangered Hawaiian hoary bats, which are difficult to detect. <br /> • Possible adverse effect or impairment of valued resources: The property does not <br /> abut the shoreline, therefore Hawaiian gathering and fishing rights is not an issue. <br /> Native plants may be destroyed by ground alteration. There is no evidence that <br /> the flora in the area are particularly desired or used for cultural practices. <br /> • Feasible actions to protect native Hawaiian rights: There is no evidence that <br /> traditional and customary native Hawaiian rights are exercised on the property; <br /> therefore no action is necessary to protect these rights. A condition of approval <br /> will be included to require the applicant to notify the DLNR-SHPD should any <br />
