SECTION 3. Chapter 21, article 3, division 4, of the Hawaii County Code 1983 (1995 <br /> edition), as amended by Ordinance No. 96-51, section 3, is amended by deleting the following <br /> language: <br /> [Section 21- . Approval of extensions of the public sewer system. <br /> (a) All sewer extensions shall be approved by resolution of the County <br /> Council. <br /> (b) Private development and construction. Once an applicant for an extension <br /> of the public sewer system has been approved by the Chief Engineer or <br /> their designee, the application and a recommendation from the Chief <br /> Engineer shall be forwarded to the County Council with all of the <br /> supporting material attached. Upon review of the recommendation of the <br /> Chief Engineer and the payment mechanism chosen by the applicant, the <br /> Council may approve the application.] <br /> SECTION 4. Material to be repealed is bracketed. New material is underscored. In <br /> printing this ordinance, the brackets, bracketed material and underscoring need not be included. <br /> SECTION 5. Severability. If any provision of this ordinance, or the application thereof <br /> to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br /> applications of the ordinance which can be given effect without the invalid provision or <br /> application, and to this end, the provisions of this ordinance are declared to be severable. <br /> SECTION 6.
