COUNTY OF HAWAII <br /> STATE OF HAWAII <br /> RESOLUTION NO. 368-14 <br /> RESOLUTION PROVIDING FOR THE ACQUISITION OF PRIVATE PROPERTIES <br /> BY EMINENT DOMAIN, BEING PORTIONS OF TAX MAP KEY: (3) 2-2-027:058 <br /> (PARCEL 2), (3) 2-2-036:019 (PARCEL 16), (3) 2-2-036:018 (PARCEL 17) AND <br /> (3) 2-2-036:077 (PARCEL 24) SITUATED AT WAIAKEA, DISTRICT OF SOUTH <br /> HILO, COUNTY AND STATE OF HAWAII, FOR THE DEVELOPMENT AND <br /> CONSTRUCTION OF A RIGHT OF WAY PARCEL NEEDED FOR THE MANONO <br /> STREET IMPROVEMENTS, JOB NO. P-3828. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII. <br /> WHEREAS, the County of Hawai`i is proceeding with the widening of Manono <br /> Street between Lanikaula and Kekuanao`a Streets; <br /> WHEREAS, the project seeks to improve bicycle and pedestrian accessibility and <br /> vehicular circulation, as well as drainage conditions in the area; <br /> WHEREAS, the development and completion of the construction of the widening <br /> of Manono Street, that is, Manono Street Improvements, Job No. P-3828, would entail <br /> the acquiring by the County of Hawai`i of portions of additional lands described as <br /> follows in: Exhibits "1", legal description, and "2", parcel map, attached hereto and <br /> made a part hereof, for Parcel 2 consisting of approximately 500 square feet, more or <br /> less; Exhibits "3", legal description, and "4"parcel map, attached hereto and made a part <br /> hereof, for Parcel 16 consisting of approximately 500 square feet, more or less; Exhibits <br /> "5", legal description, and "6" parcel map, attached hereto and made a part hereof, for <br /> Parcel 17 consisting of approximately 1,793 square feet, more or less; Exhibits "7", legal <br /> description, and "8" parcel map, attached hereto and made a part hereof, for Parcel 24 <br /> consisting of approximately 500 square feet, more or less; and together with any adjacent <br /> lands necessary for temporary construction purposes, including but not limited to, <br /> temporary easements for construction and operations, storage and disposal areas; and <br /> WHEREAS, the completion of the widening of Manono Street has been <br /> determined by the County of Hawai`i as providing a public use and purpose which will <br /> benefit the County of Hawai`i; <br /> WHEREAS, the County of Hawai`i deems it necessary to invoke its <br /> condemnation powers in acquiring the additional lands to complete the widening of <br /> Manono Street; and <br /> WHEREAS, Section 101-13 of the Hawai`i Revised Statutes requires that a <br /> condemnation action by the County of Hawai`i must be authorized by a resolution of the <br /> County Council. <br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that <br /> the Council of the County of Hawai`i finds that it is necessary for the public use and <br /> purpose for the benefit of the County of Hawai`i, to wit: the widening of Manono Street <br /> at Waiakea, District of South Hilo, County and State of Hawai`i, to take, acquire and <br /> condemn portions of the additional lands described as follows: Exhibits "1", legal <br /> description, and "2", parcel map, attached hereto and made a part hereof, for Parcel 2 <br /> consisting of approximately 500 square feet, more or less; Exhibits "3", legal description, <br /> Hawai`i County is an Equal Opportunity Provider and Employer <br />
