and "4" parcel map, attached hereto and made a part hereof, for Parcel 16 consisting of approximately 500 square feet, more or less; Exhibits "5", legal description, and "6" parcel map, attached hereto and made a part hereof, for Parcel 17 consisting of approximately 1,793 square feet, more or less; Exhibits "7", legal description, and "8" parcel map, attached hereto and made a part hereof, for Parcel 24 consisting of approximately 500 square feet, more or less; and together with any adjacent lands necessary for temporary construction purposes, including but not limited to, temporary easements for construction and operations, storage and disposal areas. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the Corporation Counsel of the County of Hawai`i be and is hereby authorized and empowered to initiate proceedings in eminent domain, as provided by law, for the taking, acquisition and condemnation of the aforesaid land. BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that the process of said proceedings in eminent domain, the Corporation Counsel be and is hereby authorized and empowered to negotiate terms of settlement, subject to the approval of the Court before which such proceedings are prosecuted. BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed to transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the County of Hawai`i; (2) the Department of Public Works; (3) to all subject landowners; and (4) Senior Deputy Corporation Counsel Joseph K. Kamelamela. Introduced by: VALERIE T.
