and "4" parcel map, attached hereto and made a part hereof, for Parcel 16 consisting of <br /> approximately 500 square feet, more or less; Exhibits "5", legal description, and "6" <br /> parcel map, attached hereto and made a part hereof, for Parcel 17 consisting of <br /> approximately 1,793 square feet, more or less; Exhibits "7", legal description, and "8" <br /> parcel map, attached hereto and made a part hereof, for Parcel 24 consisting of <br /> approximately 500 square feet, more or less; and together with any adjacent lands <br /> necessary for temporary construction purposes, including but not limited to, temporary <br /> easements for construction and operations, storage and disposal areas. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAII that the Corporation Counsel of the County of Hawai`i be and is hereby <br /> authorized and empowered to initiate proceedings in eminent domain, as provided by <br /> law, for the taking, acquisition and condemnation of the aforesaid land. <br /> BE IT FURTHER RESOLVED BY THE COUNCIL OF THE COUNTY OF <br /> HAWAI`I that the process of said proceedings in eminent domain, the Corporation <br /> Counsel be and is hereby authorized and empowered to negotiate terms of settlement, <br /> subject to the approval of the Court before which such proceedings are prosecuted. <br /> BE IT FINALLY RESOLVED that the Clerk of the County of Hawai`i is directed <br /> to transmit copies of this resolution to (1) the Honorable William P. Kenoi, Mayor of the <br /> County of Hawai`i; (2) the Department of Public Works; (3) to all subject landowners; <br /> and (4) Senior Deputy Corporation Counsel Joseph K. Kamelamela. <br /> Introduced by: <br /> VALERIE T.
