..411 <br /> COUNTY OF HAWAII ... �' /, ..> STATE OF HAWAII <br /> ,rt OF•MF••/, <br /> RESOLUTION NO. 508 14 <br /> RESOLUTION AUTHORIZING THE GRANT OF EASEMENT FOR ACCESS <br /> PURPOSES AFFECTING WAIKAUMALO-MAULUA HOMESTEADS ROAD <br /> ADJACENT TO TMK: (3) 3-2-002-047; (3) 3-2-002-046, (3) 3-2-003-008 AND <br /> (3) 3-2-003-03, NORTH HILO, ISLAND OF HAWAII, HAWAII TO PAUL DOLNICK. <br /> WHEREAS, the County of Hawai`i is the owner of the used road portion of <br /> Waikaumalo-Maulua Homesteads Road, District of North Hilo, County and State of Hawai`i, <br /> adjacent to Tax Map Key (3) 3-2-002-047; (3) 3-2-002-046, (3) 3-2-003-008 and (3) 3-2-003-03, <br /> more particularly described in Exhibits "A-1", "A-2" and "B" and being the gravel roadway <br /> constructed over a portion of Waikaumalo-Maulua Homesteads Road adjacent Tax Map Key: <br /> (3) 3-2-002-047; (3) 3-2-002-046, (3) 3-2-003-008 and(3) 3-2-003-03, as delineated on Exhibit <br /> "B" attached hereto; <br /> WHEREAS, Paul Dolnick constructed a gravel roadway over a portion of <br /> Waikaumalo-Maulua Homesteads Road and such roadway is the only roadway to Paul Dolnick's <br /> residence; <br /> WHEREAS, Paul Dolnick has been using said roadway, with a gate across it, since <br /> November 2012; <br /> WHEREAS, pursuant to a request by the Department of Public Works, Paul Dolnick <br /> seeks to obtain proper legal access to the used road portion of Waikaumalo-Maulua Homsteads <br /> Road for roadway purposes; <br /> WHEREAS, Paul Dolnick requests an easement be granted to use the County of <br /> Hawai`i's used road portion of Waikaumalo-Maulua Homesteads Road to be exclusively used by <br /> him, his authorized permittees, and successors to access his property located at 32-1007 Kapena <br /> Road, Ninole, Hawai`i and legitimize his use; <br /> WHEREAS, such Grant of Easement has been approved by the Planning Department, <br /> Department of Public Works, Department of Water Supply, and the Department of <br /> Environmental Management; <br /> WHEREAS, Section 2-111 of the Hawai`i County Code authorizes the Council, by <br /> resolution approved by a majority, to direct the finance director to grant easements from the <br />
