'r�Y os k <br /> COUNTY OF HAWAII • * STATE OF HAWAII <br /> RESOLUTION NO. 519 14 <br /> A RESOLUTION APPROVING AND ADOPTING A SUPPLEMENTAL REPORT OF THE <br /> DIRECTOR OF ENVIRONMENTAL MANAGEMENT REGARDING THE PROPOSED <br /> SEWER IMPROVEMENT DISTRICT FOR THE LONO KONA SUBDIVISION, <br /> AMENDING RESOLUTION NO. 264-14 PERTAINING TO THE PROPOSED DISTRICT, <br /> AND PROVIDING FOR A PUBLIC HEARING REGARDING THE PROPOSED <br /> DISTRICT <br /> WHEREAS, pursuant to Resolution No. 264-14, adopted on January 22, 2014, the County <br /> Council (the "Council") of the County of Hawai`i (the "County") determined to proceed with <br /> further actions regarding the proposed establishment of a Sewer System Improvement District (the <br /> "Improvement District") to fund the costs of a public sewer system for the Lono Kona Subdivision <br /> in accordance with Chapter 12, Hawai`i County Code 1983 (2005 Edition), as amended (the <br /> "County Code"): and <br /> WHEREAS, in determining to proceed with such actions, the Council adopted the findings, <br /> conclusions and recommendations set forth in the Director's Report (Communication No. 492.1) <br /> dated December 11, 2013 (the "Director's Report") submitted by the Director of Environmental <br /> Management (the "Director") with respect to the proposed Improvement District, including <br /> findings, conclusions and recommendations relating to the proposed assessment of properties within <br /> the Improvement District to pay or reimburse the County for the costs of the Improvements and/or <br /> the debt service on bonds issued by the County to pay such costs; and <br /> WHEREAS, the proposed assessment roll for the Improvement District, as set forth in the <br /> Director's Report and adopted pursuant to Resolution No. 264-14, is based on the single family <br /> equivalents ("SFEs") calculated for the assessed properties within the Improvement District on the <br /> basis of the existing the use of such properties or, in the case of vacant lots, their permitted use <br /> under existing zoning; and <br />
