WHEREAS, pursuant to Resolution No. 264-14 and Section 12-28 of the County Code, a <br /> combination public hearing was held on March 18, 2014 to provide property owners and other <br /> interested parties with an opportunity to be heard regarding the proposed Improvement District; and <br /> WHEREAS, in accordance with Sections 12-10(e) and 12-12 of the County Code, property <br /> owners were advised that they were entitled to submit written protests regarding the proposed <br /> Improvement District at or prior to the public hearing and that the County would not proceed with <br /> the establishment of the Improvement District if protests from the owners of properties representing <br /> fifty percent(50%) or more of the total assessments based on SFEs; and <br /> WHEREAS, although written protests received from property owners represented less than <br /> seven percent (7%) of the total assessments, the County received certain information indicating that <br /> the proposed assessments for certain properties may have been based on inaccurate information <br /> regarding the actual uses of such properties and, in view of such information, the County advised <br /> the property owners that the County would undertake a further review of the proposed assessment <br /> roll and revise the same as indicated by this review, that the property owners would have an <br /> opportunity to review and comment on the revised assessment roll, that an additional public hearing <br /> would be held with respect to the proposed Improvement District and the revised assessments, and <br /> that property owners would be afforded a further opportunity to file written protests at or prior to <br /> the public hearing; and <br /> WHEREAS, after further review, the proposed assessment roll was revised and, after the <br /> property owners were afforded an opportunity to review and comment on their assessments, the <br /> revisions were adopted by the Director and set forth in an amendment to the Director's Report <br /> (Communication No. 1029.1) dated September 8, 2014 (the "Amendment to Director's Report") <br /> submitted by the Director, a copy of which is attached as Exhibit A hereto and incorporated herein <br /> by this reference; and <br /> WHEREAS, the County Council intends hereby to approve and adopt the Amendment to <br /> Director's Report, to amend Resolution No. 264-14 with respect to the revised assessment roll and <br /> other information set forth in the Amendment to Director's Report and to call a further public <br /> hearing regarding the proposed Improvement District; now, therefore, <br /> 2 <br />
