J Yoshimoto, Council Chair <br /> and Members of the County Council <br /> Page 5 <br /> • Investigation of valued resources: No formal archaeological, floral or faunal <br /> studies were conducted of the property because it has historically been cultivated <br /> in sugar cane. <br /> • The valued cultural, historical, and natural resources found in the rezoning area: <br /> According to the applicants, there are no valued cultural, historical and natural <br /> resources found on the property because it was previously used for growing sugar <br /> cane. <br /> • Possible adverse effect or impairment of valued resources: Given the scope of <br /> previous agricultural use of the property and the property's urban setting, no <br /> known rare, threatened, or endangered species are known to inhabit the parcel or <br /> are expected to be discovered on the site. <br /> • Feasible actions to protect native Hawaiian rights: According to the applicants, <br /> no gathering or other cultural practices are taking place on the site. Thus, to the <br /> extent to which traditional and customary native Hawaiian rights are exercised, <br /> the proposed action will not affect traditional Hawaiian rights; therefore, no action <br /> is necessary to protect these rights. <br /> Lastly, this approval is made with the understanding that the applicants remains <br /> responsible for complying with all other applicable governmental requirements in <br /> connection with the approved use, prior to its commencement or establishment upon <br /> the subject properties. Additional governmental requirements may include the issuance <br /> of building permits, the installation of approved wastewater disposal systems, <br /> compliance with the Fire Code, installation of improvements required by the American <br /> with Disabilities Act (ADA), among many others. Compliance with all applicable <br /> governmental requirements is a condition of this approval; failure to comply with such <br /> requirements will be considered a violation that may result in enforcement action by the <br /> Planning Department and/or the affected agencies. <br /> Based on the above findings, the approval of the change of zone from an <br /> Agricultural 1-acre(A-1 a) to a Neighborhood Commercial 20,000-square foot(CN-20) <br /> zoned district would result in an appropriate land use pattern and further benefit the <br /> general public. <br />
