COUNTY OF HAWAI `I <br />STATE OF HAWAII <br />RESOLUTION NO. 598 14 <br />RESOLUTION AUTHORIZING THE OFFICE OF THE PROSECUTING ATTORNEY <br />TO ENTER INTO AN AGREEMENT WITH THE STATE OF HAWAII, DEPARTMENT <br />OF PUBLIC SAFETY, SHERIFF DIVISION, HAWAII ISLAND SECTION, PURSUANT <br />TO HRS 46 -7, AND TRANSFER OWNERSHIP OF TWO (2) LIVESCAN UNITS <br />(INCLUDES A LAPTOP, CAMERA AND CASE), TWO (2) DELL LATITUDE E.5510 <br />LAPTOPS AND TWO (2) DELL LASER PRINTERS TO THE STATE OF HAWAII, <br />DEPARTMENT OF PUBLIC SAFETY, SHERIFF DIVISION, HAWAII ISLAND <br />SECTION. <br />WHEREAS, in 2011 and 2012, the Office of the Prosecuting Attorney acquired through <br />Federal grant funds under the Courthouse Booking Program, (2) Livescan Units (includes a <br />laptop, camera and case), (2) Dell Latitude E5510 laptops and (2) Dell Laser printers; and that <br />pursuant to an inter - agency agreement under the grant, this equipment was used by Deputy <br />Sheriffs in the courthouses in Hilo and Kona to process offenders at the courthouse, rather than <br />have them report to the police stations for processing at a later time; and that the activities under <br />this grant resulted in more accurate records, saved police and court resources; and <br />WHEREAS, Hawai'i Revised Statutes, Section 46 -7, requires that County departments <br />obtain consent of the Council to enter into agreements with the federal or state governments <br />respecting action to be taken pursuant to any of the powers granted by law to furnish, expend, <br />and receive any funds or other assistance in connection with projects being or to be undertaken <br />pursuant to those powers; and <br />WHEREAS, the State of Hawaii, Department of Public Safety, Sheriff Division, has executed <br />an indemnification agreement with the County of Hawaii, and has possession of said equipment <br />since they were received and are utilized on a daily basis to facilitate court ordered processing; <br />and <br />WHEREAS, one unit is located at the Hilo court house, Hale Kaulike, located at 777 <br />Kilauea Avenue, Hilo, Hawaii and one unit is located at the Kona court house located at 79- <br />1020 Haukapila Street, Kealakekua, Hawaii; and <br />WHEREAS, Hawaii Revised Statutes Section 46 -7 provides that the Office of the <br />Prosecuting Attorney, with the consent of the Council, on behalf of the County of Hawaii, may <br />furnish or expend funds or other assistance in connection with projects or to be undertaken <br />pursuant to its governing powers; now, therefore, <br />
