<br />SEWER SYSTEM IMPROVEMENT DISTRICT
<br />LONO KONA SUBDIVISION, NORTH KONA, HAWAII
<br />TO THE OWNERS OF LANDS TO BE ASSESSED AND /OR ACQUIRED WITHIN SAID
<br />IMPROVEMENT DISTRICT AND TO ALL PERSONS INTERESTED GENERALLY:
<br />,Pursuant to Resolution No. 264 -14, adopted on January 22, 2014, as amended by Resolution
<br />1519 -14, adopted on October 1, 2014, the Hawaii County Council proposes to establish a
<br />Sewer System Improvement District (the "Improvement District ") for the Lono Kona
<br />Subdivision, North Kona, Hawaii, and to assess properties within said Improvement
<br />District as provided in Chapter 12, Hawai'i County Code.
<br />Pursuant to the requirements of Sections 12- 10(e), 12 -27 and 12 -28, Hawaii County Code
<br />notice is hereby given of the following:
<br />1. General Details of Proposed Improvements
<br />This Improvement District is being initiated by the Hawaii County Council for the design
<br />.and installation of a public sewer system for the Lono Kona Subdivision (the "Special
<br />!Improvements"), as more fully described in an amended report on the proposed
<br />establishment of the Improvement District from the Director of the Hawai'i County
<br />Department of Environmental Management (Communication No. 492.1) dated
<br />December 11, 2013 (including the Exhibits attached thereto, the "Director's Report")., The
<br />Director's Report includes, among other things: (i) a map showing the locations of the
<br />Special Improvements; (ii) a preliminary assessment roll for the Improvement District;
<br />(iii) a description of assessment units to be assessed within the Improvement District,
<br />including the method of assessment of each assessment unit, the maximum proposed
<br />assessment for each assessment unit and a list of all known owners of the assessment
<br />units; and (iv) an estimate of the costs of the Special Improvements by the Director of the
<br />Department of Environmental Management. The Director's Report was further amended
<br />by a letter dated September 8, 2014, to the County Council (Communication No. 1029.1)
<br />(the "Amendment to Director's Report"); which includes a revised assessment roll as
<br />Exhibit A thereto.
<br />Scope and Location of Special Improvements. This Improvement District consists of 145
<br />"assessment units" (i.e., subdivided parcels or condominium units) on 110 lots within the
<br />Lono Kona Subdivision, as identified (by tax map key number and property owner) in the
<br />revised assessment roll included in the Amendment to Director's Report. The Special
<br />Improvements will, include, without limitation:
<br />u 5,640 Lin. Ft., 8 -inch PVC SDR -26 sewer pipe and fittings;
<br />u 360 Lin: Ft., 10 -inch PVC SDR -26 sewer pipe and fittings;
<br />u 29 Each, sewer manholes 5.0' to 9.5' deep;
<br />u 4 Each, lined shallow drop sewer manholes 10.0' to 14.99' deep;
<br />u 1 Each, lined drop sewer manholes 15.00' to 20.00' deep; and
<br />P 110 Each, sewer lateral connections.
<br />Estir
<br />na- t_ed Cost,of�ecial Improvement_s_., The total estimated cost of the Improvement
<br />District is $6,461,800. Assuming the project costs to be equal to such estimate, and,
<br />further assuming a U.S.D.A. Rural Utilities Service Grant in the amount of $4,024,800 to be
<br />applied against the project costs, the net project costs would be $2,437,000.
<br />Method of Assessment. Each assessment unit existing as of the date that assessments
<br />begin to accrue shall be subject to an assessment calculated by:
<br />(1) dividing the Net Project Costs by the total number of single - family equivalents
<br />("SFEs ") represented by all assessment unitsin the Improvement District, and
<br />(2) with respect to each assessment unit, multiplying the amount determined
<br />pursuant to (1) above by the number of SFEs represented by such assessment
<br />unit.
<br />SFEs reflect estimated wastewater generation by land use (specifically, single - family,
<br />duplex, apartment or commercial), as determined in the manner set forth in the
<br />Director's Report based on (i) each assessment unit's existing land use, or (ii)'in the case
<br />of vacant land, the existing zoning for such land. Assuming net project costs of
<br />$2,437,000, the anticipated assessment per SFE will be $9,090. The total assessment for
<br />each assessment unit will depend on the number of SFEs represented by that unit, asset
<br />forth in the revised assessment roll included in the Amendment to Director's Report.
<br />Pursuant to HRS §46 -74.1, §46 -74.2, and Hawaii County Code §12 -5, the assessments for 10
<br />properties owned by qualifying nonprofits will be paid for by the County. The total cost is
<br />•$294,526 for 32.4 SFEs.
