WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving <br />by dedication any streets in any subdivision platted after December 2, 1966, except upon full <br />compliance with the provisions of Chapter 23; and <br />WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br />council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds <br />the subject subdivision and improvements thereon are in full compliance with the provisions of <br />Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. <br />BE IT FURTHER RESOLVED, in accordance with Article XIII, Section 13-12 of the <br />Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii <br />accepts the dedication of Road Lot 33 (Kamanu Street stub-out/extension), containing an area of <br />approximately 0.560 acre; Road Lot 34 (Kaiakoili Street), containing an area of approximately 0.852 <br />acre; Road Lot 35 (Maiau Street), containing an area of approximately 0.825 acre; Road Lot 36 <br />(Kauhola Street), containing an area of approximately 0.823 acre; Road Lot 37 (Olowalu Street) <br />containing an area of approximately 0.998 acre; and Road Lot 38 (Kamanu Street widening), <br />containing an area of approximately 0.249 acre, more or less, identified as Tax Map Keys: (3) 7-3- <br />051:131, 132, 133, 134, 135 and 136, delineated on Exhibit "A" attached hereto, including all <br />improvements thereon, for public road purposes. <br />BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor <br />William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Katherine A. <br />
