WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving by dedication any streets in any subdivision platted after December 2, 1966, except upon full compliance with the provisions of Chapter 23; and WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds the subject subdivision and improvements thereon are in full compliance with the provisions of Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. BE IT FURTHER RESOLVED, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter, and Section 23-10 of the Hawaii County Code, that the County of Hawaii accepts the dedication of Road Lot 33 (Kamanu Street stub-out/extension), containing an area of approximately 0.560 acre; Road Lot 34 (Kaiakoili Street), containing an area of approximately 0.852 acre; Road Lot 35 (Maiau Street), containing an area of approximately 0.825 acre; Road Lot 36 (Kauhola Street), containing an area of approximately 0.823 acre; Road Lot 37 (Olowalu Street) containing an area of approximately 0.998 acre; and Road Lot 38 (Kamanu Street widening), containing an area of approximately 0.249 acre, more or less, identified as Tax Map Keys: (3) 7-3- 051:131, 132, 133, 134, 135 and 136, delineated on Exhibit "A" attached hereto, including all improvements thereon, for public road purposes. BE IT FINALLY RESOLVED that a copy of this resolution be forwarded to: (1) Mayor William P. Kenoi; (2) the Department of Public Works; (3) Deputy Corporation Counsel Katherine A.
