COUNTY OF HAWAII <br />STATE OF HAWAII <br />RESOLUTION NO. 166 15 <br />RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOT (12.5 FEET WIDE RIGHT- <br />OF-WAY), BEING A PORTION OF ALLOTMENT 14 OF HOLUALOA 1 & 2 PARTITION <br />(MAUKA SECTION) BEING A PORTION OF ROYAL PATENT 4475, LAND COMMISSION <br />AWARD 7713, APANA 43 TO VICTORIA KAMAMALU, TAX MAP KEY: (3) 7-6-004:059, <br />SITUATED AT HOLUALOA 1 & 2, DISTRICT OF NORTH KONA, ISLAND OF HAWAII <br />FROM MILLICENT A. GRAND, SUCCESSOR TRUSTEE OF THE LILLIAN U. TOWATA <br />REVOCABLE LIVING TRUST DATED JANUARY 24, 1999. <br />WHEREAS, Millicent A. Grand, Successor Trustee of The Lillian U. Towata Revocable <br />Living Trust dated January 24, 1999 ("Grand") is the owner of a Road Lot (12.5 feet wide Right -of - <br />Way), containing an area of 1,657 square feet, more or less, identified as a portion of Tax Map <br />Key: (3) 7-6-004:059, situate at Holualoa 1 & 2, District of North Kona, Island of Hawaii, as <br />delineated on Exhibit "A" attached hereto; and <br />WHEREAS, Condition E of Ordinance No. 12-76, required an additional 12.5 feet wide Right - <br />of -Way, along the property's Old Government Road frontage to be dedicated to the County; and <br />and <br />WHEREAS, Grand received final subdivision approval for the above referenced Road Lot; <br />WHEREAS, Grand is desirous of dedicating the above Road Lot to the County of Hawaii for <br />roadway purposes, and such dedication has been approved by the County of Hawaii Department of <br />Public Works, and received dedication approval from the Department of Water Supply, Planning <br />Department and Department of Environmental Management; and <br />WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter, provides that the <br />council may accept gifts, which include the dedication of land, on behalf of the County of Hawaii <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds <br />the subject subdivision and any improvements thereon are in full compliance with the provisions of <br />Chapter 23 of the Hawaii County Code as certified and approved by all applicable agencies. <br />
