Per your prior directions we met with Mr.Terry Dunlap regarding <br /> the Kona CDP Design Center review on this matter and are hereby submitting the attached package for a <br /> Planning Commission hearing requesting approval of an additional time extension to comply with <br /> Condition C(complete construction)of Change of Zone Ordinance No. 05-74(copy attached). <br /> Since August 2013 we have been diligently completing the processing for the build-out of this 92 unit <br /> residential condominium subdivision, more commonly known as Hale Nanea Condominiums (site plan <br /> attached). As a result of the damage done to the housing industry by the financial market collapse of <br /> recent years, our efforts have been met with unforeseen head winds and challenging hurdles which have <br /> led to unprecedented delays. Along with our NPDES Permit and Grading Permit, on November 24,2014 <br /> we received the final approvals to pull building permits on the first forty-four (44) condominiums (see <br /> copies attached). Securing a bank and/or construction lender to start the project has proven to be the most <br /> challenging with what is left of the financial•lending marketplace. With the project now permit ready <br /> which was a lender commitment condition, our construction lender is requesting and mandating us to <br /> receive the Condition C five (5) year time extension from the County of Hawaii Planning Commission <br /> before they will fund the construction loan. <br /> We are hereby requesting an additional 5 year time extension for the performance of the conditions of <br /> Ordinance No. 05-74 since the non-performance is the result of conditions that could not have been <br /> foreseen and were beyond our control and are not the result of any fault or negligence by us. Granting of <br /> an additional extension of time is not contrary to the General Plan or Zoning Code and is not contrary to <br /> Planning Dept, <br /> Exhibit _�_ <br />
