Exhibit 3—Letter dated September 3,2015 from Sidney Fuke <br /> regarding ownership of property) <br /> STATE AND COUNTY PLANS <br /> 5. State Land Use District: Agricultural. <br /> 6. General Plan LUPAG Map Designation: The makai half of the property is designated <br /> Low Density Urban and the mauka half is designated Important Agricultural Land. The <br /> Low Density Urban designation allows residential uses (up to six units per acre), with <br /> ancillary community and public uses, and neighborhood and convenience-type <br /> commercial uses. Important Agricultural Lands are those with better potential for <br /> sustained high agricultural yields because of soil type, climate, topography, or other <br /> factors. <br /> 7. County Zoning: Agricultural-20 acres (A-20a). The Agricultural zoning district <br /> provides for agricultural and very low density agriculturally-based residential use, <br /> encompassing rural areas of good to marginal agricultural and grazing land, forest land, <br /> game habitats, and areas where urbanization is not found to be appropriate. <br /> 8. Kona Community Development Plan (CDP): The Kona CDP, adopted by the Hawai`i <br /> County Council on September 25, 2008,identifies the property halfway inside the"Kona <br /> Urban Area". The line defining the Urban Area, matches with the General Plan LUPAG <br /> designations and divides the property approximately in half with the mauka portion being <br /> located in the Rural Area and the makai portion in the Urban Area. <br /> DESCRIPTION OF PROPERTY AND SURROUNDING AREA <br /> 9. Subject Property: The property is rectangular in shape. It has a fairly steep topography <br /> sloping upward from west to east with a slope of about 10-15%. The elevation ranges <br /> from 1,670 to 1,840 feet. A dwelling located near the front of the property that was built <br /> in 1960 will be demolished. <br /> 10. Surrounding Zoning and Land Uses: The primary land use in the Kalaoa area is <br /> residential on agricultural-zoned lots of various sizes ranging from 10,000-square feet in <br /> -2- <br />
