BHootaAmendREZ.mjj 9/22/15 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> ERIC AND JOSLYN HOOTA <br /> AMENDMENT TO CONDITION E <br /> CHANGE OF ZONE ORDINANCE NO. 94 06 (REZ 758) <br /> ERIC AND JOSLYN HOOTA request an amendment to Conditions E(complete <br /> construction) of Change of Zone Ordinance 94 06, which rezoned approximately 26,770 square <br /> feet of land from Single-Family Residential-10,000 square feet(RS-10) to General Commercial- <br /> 10,000 square feet(CG-10). The property is located on the southeast(Puna-makai) corner of the <br /> Kino`ole and Lono Streets intersection in Waiakea House Lots, Waiakea, South Hilo, Hawai`i, <br /> TMK: 2-2-024:008. <br /> PROPOSED ACTION <br /> 1. Request: The applicants request a 5-year time extension to comply with Condition E of <br /> Change of Zone Ordinance No. 94 06, which states: <br /> "Construction of the proposed commercial development shall be completed <br /> within three(3) years from the effective date of this ordinance." <br /> This condition required that construction be completed by January 26, 1997. In 1996, the <br /> Planning Director issued an administrative time extension until January 26, 2000 to <br /> complete construction. The applicants are requesting a 5-year time extension from the <br /> date of approval of this proposed amendment to complete construction of a medical <br /> office building or other commercial development. <br /> 2. Reasons for Request: The applicants have been unable to proceed with construction of <br /> the project due to unforeseen personal health issues and the recent recession. They are <br /> committed to completing construction of an office building to accommodate a dental <br /> laboratory and financial services office for the applicants,businesses that they currently <br /> conduct in other locations in Hilo, and other commercial opportunities. <br /> 3.
