<br /> RESOLUTION ACCEPTING THE DEDICATION OF ROAD LOTS 50, 51, R-3, R-2-B, 501,
<br /> 502, 503, 6-C AND 142, BEING A PORTION OF TAX MAP KEY NOS.: (3) 7-3-060:051 (POR),
<br /> (3) 7-3-061:053 AND 054, AND (3) 7-3-010:057, SITUATE AT KALAOA 5TH, DISTRICT OF
<br /> NORTH KONA, ISLAND OF HAWAII, STATE OF HAWAII, FROM TRI INDEX
<br /> HOLDINGS, INC., A HAWAII CORPORATION.
<br /> WHEREAS, Tri Index Holdings, Inc., a Hawai`i corporation, is the owner of Road Lots 50,
<br /> 51, R-3, R-2-B, 501, 502, 503, 6-C and 142, portions of which contains an area of 0.603 acres, 0.663
<br /> acres, 1.092 acres, 0.928 acres, 3.293 acres, 20,736 square feet, 18,810 square feet, 1.839 acres and
<br /> 3.230 acres, more or less, respectively, identified as a portion of Tax Map Key Nos.: (3) 7-3-060:051
<br /> (por.), (3) 7-3-061:053 & 054 and(3) 7-3-010:057, situate at Kalaoa 5th, District of North Kona, Island
<br /> of Hawai`i, State of Hawai`i, as delineated on Exhibit "A" attached; and
<br /> WHEREAS, Condition G, Rezoning Ordinance No. 98-66 required the main access road and
<br /> interior subdivision roads to be dedicated to the County of Hawai`i; and
<br /> WHEREAS, Tri Index Holdings, Inc., a Hawaii corporation, has constructed all subdivision
<br /> improvements and received final subdivision approval; and
<br /> WHEREAS, Tri Index Holdings, Inc., a Hawai`i corporation, is desirous of dedicating the
<br /> above roadway lots, including all subdivision improvements thereon, to the County of Hawai`i for
<br /> roadway purposes, and the improvements have been inspected and approved by the County of Hawai'i
<br /> Department of Public Works, and received dedication approval from the Department of Water Supply,
<br /> Planning Department and Department of Environmental Management; and
<br /> WHEREAS, Section 23-10 of the Hawaii County Code prohibits the Council from receiving
<br /> by dedication any streets in any subdivision platted after December 2, 1966 except upon full
<br /> compliance with the provisions of Chapter 23; and
<br /> WHEREAS, Article XIII, Section 13-12 of the Hawai`i County Charter, provides that the
<br /> council may accept gifts, which include the dedication of land, on behalf of the County of Hawai`i.
<br /> BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that it finds
<br /> the subject subdivision and improvements thereon are in full compliance with the provisions of
