COUNTY OF HAWAII -• � <br /> i ' /:•`- STATE OF HAWAII <br /> •.:4 .--7,.-,- , <br /> °<N. <br /> k.4,Oi.44.. <br /> RESOLUTION NO. 328 15 <br /> A RESOLUTION AUTHORIZING THE DIRECTOR OF FINANCE TO ENTER INTO <br /> NEGOTIATIONS FOR THE ACQUISITION OF TAX MAP KEYS (3) 5-2-001:020 AND <br /> 025 KNOWN AS NIULI`I IN NORTH KOHALA, PURSUANT TO CHAPTER 2, <br /> ARTICLE 42 OF THE HAWAII COUNTY CODE 1983 (2005 EDITION, AS <br /> AMENDED). <br /> WHEREAS, Chapter 2, Article 42 of the Hawai`i County Code established the Public <br /> Access, Open Space, and Natural Resources Preservation Fund; and <br /> WHEREAS, Section 2-215 of the Hawai`i County Code established the Public Access, <br /> Open Space, and Natural Resources Preservation Commission ("the Commission"); and <br /> WHEREAS, Section 2-217 of the Hawai`i County Code provides, in pertinent part, that <br /> the Commission's first duty and responsibility is, "To develop and submit to the mayor, an initial <br /> island-wide prioritized list of qualifying lands worthy of preservation...Priorities shall be listed <br /> on an island-wide rather than district basis."; and <br /> WHEREAS, on December 26, 2014, the Commission submitted its 2014 Annual Report <br /> to the Mayor citing the purchase of Niuli`i in North Kohala as priority number three; and <br /> WHEREAS, Communication No. 163 from the Mayor, dated February 25, 2015, <br /> recommends that the Council accept the prioritized list as presented by the Commission; and <br /> WHEREAS,Niuli`i, totaling 48.138 acres, is one of the few remaining sites with a <br /> culturally significant hala forest and cliff areas where kolea(Pacific golden plover) nest, as well <br /> as a trail recognized by Na Ala Hele, the State of Hawai`i Trail and Access Program; and <br /> WHEREAS, Niuli`i is contiguous with KeOkea Beach Park and includes remnants of <br /> settlements dating back to 1250 of the forebears of Kamehameha I and many of the warriors and <br /> advisors that carried out his mission of uniting the islands, as well as the locations of two heiau; <br /> and <br /> WHEREAS, Niuli`i contains the ruins of the Niuli`i Sugar Mill, including the rail bed, <br /> turntable, and terminus of the Mahukona to Niuli`i Railroad; and <br /> WHEREAS, Niuli`i is listed for sale and the landowners are willing to sell to the <br /> County; now, therefore, <br />
