Reahole Airport in violation of any applicable federal or state <br /> requirements governing aircraft safety and any implemented <br /> noise abatement measures, nor shall it authorize or excuse any <br /> negligence or willful misconduct of the Grantee in operating <br /> the Reahole Airport. <br /> 2. Running of Benefits and Burdens. This grant of <br /> easement shall be recorded or filed with the Bureau of <br /> Conveyances of the State of Hawaii and shall be included in any <br /> conveyance or disposition of the Easement Premises by the <br /> Grantor or its successors and assigns, and all provisions of <br /> this instrument, including any benefits and burdens hereunder, <br /> shall run with the lana and are binding upon and shall inure to <br /> the heirs, assigns, successors, tenants and those claiming <br /> under or through the parties hereto. <br /> 3. Release of Easement. The Grantee or its <br /> successors and assigns may terminate this grant of easement by <br /> recording or filing a release with the Bureau of Conveyances of <br /> the State of Hawaii, whereupon all rights, duties and <br /> liabilities created by this grant of easement shall terminate. <br /> 4. Release From Suits. The Grantor, for itself, its <br /> successors and assigns does hereby release and agree not to <br /> file any claim, action or lawsuit for any kind of relief, legal <br /> or equitable, including, but not limited to, claims for <br /> nuisance and trespass against the State of Hawaii or any agency <br /> or employee thereof, for costs or damages resulting from noise <br /> caused by the establishment or operation of the Reahole <br /> Airport, including any expense incurred for mitigation of <br /> -4- <br />
