WHEREAS, creation of the Banyan Drive Hawai`i Redevelopment Agency ("BDHRA") would present an opportunity for the County to effectuate a revitalization and redevelopment of the area where hotel, resort, commercial and public uses may coexist compatibly; and WHEREAS, the BDHRA shall include the redevelopment areas as designated by the County of Hawai`i Windward Planning Commission including those Federal, State and private properties highlighted on Exhibit "A", attached hereto and incorporated by reference herein; and WHEREAS, in the initial stages, the Planning Department, as the lead agency in enabling the County to directly exercise its powers as provided for in parts I and II of Chapter 53, Hawai`i Revised Statutes, under Section 2-35.1 of the HCC, shall be designated as the lead agency for transitional purposes until the BDHRA is organized and able to perform the duties as required under the statute; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that pursuant to Chapter 53, Hawai`i Revised Statutes, as amended, the County Council of the County of Hawai`i hereby establishes the Banyan Drive Hawai`i Redevelopment Agency, which shall exercise its powers as provided for in parts I and II of Chapter 53, Hawai`i Revised Statutes, as amended; and it does hereby authorize the Mayor to appoint, with the approval of the Council, five members to said Agency who shall reside in the County for at least three years immediately preceding their appointments, one to serve for a term of one (1) year, one for a term of two (2) years, one for a term of three (3) years, one for a term of four(4) years, and one for a term of five (5) years, and thereafter, their successors to serve for terms of five years, and no more than three of whom shall belong to the same political party. 2
