Dru Kanuha, Council Chair <br /> and Members of the County Council <br /> Page 4 <br /> The original applicant proposed to construct an office building on the subject site <br /> and for that reason, the County Council did not include a Fair Share requirement in the <br /> original ordinance. As the current applicant is proposing a project with a Multiple- <br /> Family residential component and as the CV zoning allows for residential uses, we are <br /> recommending that the County Council include a Fair Share requirement as part of the <br /> amendment to this Ordinance. In addition, to ensure that the Goals and Policies of the <br /> Housing Element of the General Plan are implemented, the standard housing condition <br /> will be added. <br /> Based on the preceding,the proposed request will not unreasonably burden public <br /> agencies to provide for infrastructure and utilities to the project site. <br /> Additionally, the request to amend Condition C to allow a time extension to <br /> complete construction of the proposed project is not contrary to the original reasons for <br /> granting the change of zone. <br /> Lastly, this recommendation is made with the understanding that the applicant <br /> remains responsible for complying with all other applicable governmental requirements <br /> in connection with the proposed use,prior to its commencement or establishment upon <br /> the subject property. Additional governmental requirements may include the issuance of <br /> building permits, compliance with the Fire Codc, installation of improvements required <br /> by the American with Disabilities Act (ADA), among many others. Compliance with all <br /> applicable governmental requirements is a condition of this approval; failure to comply <br /> with such requirements will be considered a violation that may result in enforcement <br /> action by the Planning Department and/or the affected agencies. <br /> Based on the above findings, the Planning Director recommends that a favorable <br /> recommendation be forwarded to the County Council to amend Ordinance No. 03 <br /> 115. <br /> The accompanying draft bill reflecting an amendment to conditions of Ordinance <br /> No. 03-115 is provided for your favorable consideration. The Planning Director recommends <br /> that existing conditions in the ordinance be revised to reflect the current standard language for <br /> conditions of approval, housekeeping revisions, and requested changes as indicated above <br /> (Material to be deleted is bracketed and strike through and material to be added is underscored). <br />
