BTanteUrbankEZAmend.cdc 3/24/16 <br /> COUNTY OF HAWAII PLANNING DEPARTMENT <br /> BACKGROUND REPORT <br /> TANTE URBAN <br /> CHANGE OF ZONE ORDINANCE NO. 03 115 (REZ 1020) <br /> AMENDMENT TO CONDITION C <br /> TANTE URBAN has submitted a request for a 5-year time extension to Condition C <br /> (time to complete construction) of Change of Zone Ordinance No. 03-115, which rezoned 7,501 <br /> square feet of land from a Multiple-Family Residential -1,000 square feet(RM-1) to a Village <br /> Commercial-7,500 square feet (CV-7.5) zoning district. The subject property is located at <br /> 75-5733 Kalawa Street, approximately 150 feet south of its intersection with Kalani Street, <br /> Honuaula,North Kona, Hawai`i , TMK: 7-5-022:040. <br /> APPLICANT'S REOUEST <br /> 1. Request: The applicant has submitted a request to amend Condition C of Change of <br /> Zone Ordinance No. 03-115, which states: <br /> "Construction of the proposed development shall be completed within five (5) <br /> years from the effective date of this ordinance. This time period shall include <br /> securing Final Plan Approval from the Planning Director in accordance with the <br /> Zoning Code. Plans shall identify proposed structure(s), fire protection measures, <br /> access roadway, driveway and parking stalls. The applicant shall provide adequate <br /> off-street parking and a turnaround before entering the County road right-of-way. <br /> Landscaping shall be indicated on the plans for the purpose of mitigating any <br /> potential adverse noise or visual impacts to adjoining parcels. Landscaping shall <br /> be provided in accordance with the requirements of Planning Department's Rule <br /> No. 17 (Landscaping Requirements)." <br /> The applicant is requesting a 5-year time extension from the date of approval of this <br /> proposed amendment to complete construction of a proposed six (6) -unit, multiple- <br /> family apartment building with a commercial kitchen on the ground floor. <br /> 2. Reasons for Request: The applicant acquired the subject property in March, 2007, and <br /> has stated that since this timeframe coincided with the economic recession. he was unable <br /> -1- <br />
