I am President of Puna Malama Pono. <br /> I have some serious reservations about this Bill. <br /> 1. At a time when the county does not have sufficient revenues to <br /> meet its expenditures, is it prudent fiscal policy to take money <br /> from the County budget to set up a fund to buy out residents <br /> impacted by a private business. If I open, say, a pig farm on my <br /> lot in Leilani and my neighbor complains of the stink does the <br /> County intend buying out my complaining neighbor? Of course it <br /> does not. Let the developer fort the bill here. Not the taxpayers <br /> and voters of the County of Hawaii. <br /> 2. The rules ford the administration of the proposed fund, as set <br /> forth by the Planning Director, Ms. Virginia Goldstein, in the <br /> Hawaii Tribune-Herald of January 9, 1997, a copy is appened to my <br /> testimony, area to my perception, arbitrary and capricious. What <br /> about a resident at one mile and one hundred feet? What about a <br /> person who bought in on October 4, 1989? What about a person who <br /> owned property within the one mile radius but dare not live there? <br /> Have they noy seen their property value fall? Are these people not <br /> impacted? Do these rules violate the rights of citizens under the <br /> Federal and State Constitutions for equal protection under the <br /> Law? <br /> 3. Should the County get into the real estate business? <br /> 4. According to the Planning Director the county would include p~ ? <br /> covenants in the resale contracts that would require the buyer not O. ~ c <br /> to complain or object to the operation of this private business. J ~ ~ r <br /> <br /> May the County do this I don't believe a person my sign away p ~ <br /> their constitutional rights to free expression. what is the County ~ Z c o <br /> going to do if they do complain? Try to uphold an illegal law?
