Consider the liability issue. Does not this proposed Fund,
despite Ms. Goldstein's protestations to the contrary reveal some
consciousness of a problem with geothermal developement? Could not
clever lawyers use the existance of this Fund to help convince a
Judge t}iat the County, by it's tacit recognition of a problem owns

a liablity towards damaged neighbors in the future? I append a map
showing PGV's own worst case scenario.
6. The proper vehicle for the mitigation of geothermal impacts

already exists. It is set forth in Condition 51 of the Geothermal
Resource Permit, GRP 87-1, approved by the Planning Commision of
the County of Hawaii. Condition 51 is also appended.
In closing I will r8ed to you Condtion One of the same permit.
"The proposed geothermal development activities would not have
unreasonable adverse health, environmental or socio-economic
effects on residents or surrounding property".
