The newly created lots would have access via a 20-foot wide existing <br /> easement connected to the end of Ho`ohoaloha Street and a newly created roadway <br /> easement within the subject property. <br /> County water is available from an existing 6-inch waterline fronting the subject <br /> property. As there is no municipal sewer system in the area, wastewater will be disposed <br /> of through individual wastewater system(s)meeting with the State Department of Health. <br /> Solid waste is currently disposed of at an authorized landfill in Hilo. Electrical and <br /> telephone services are available to the site. Police services are located about 4 miles <br /> away in downtown Hilo and fire services area located within 2 miles of the property on <br /> Kawailani Street. Medical services are available in Hilo. To limit the cumulative impact <br /> of the proposed subdivision on area infrastructure, a condition of approval will prohibit a <br /> second dwelling and condominium property regime on each lot. <br /> The request is not contrary to Chapter 205A, Hawaii Revised Statues, <br /> relating to Coastal Zone Management Area. The subject property is located over four <br /> miles from the shoreline and is not in the Special Management Area. Thus, the property <br /> will not be affected by coastal hazards and beach erosion. There are no identified <br /> recreational resources, public access to the shoreline or mountain areas, scenic and open <br /> space preserves, coastal ecosystems, marine resources or other natural and environmental <br /> resources on the subject property. <br /> In view of the Hawai`i State Supreme Court's "PASH" and"Ka Pa'akai 0 <br /> Ka'Aina"decisions, the issue relative to native Hawaiian gathering and fishing rights <br /> must be addressed in terms of the cultural, historical, and natural resources and the <br /> associated traditional and customary practices of the site: <br /> • Investigation of valued resources: No formal archaeological reconnaissance <br /> survey, oral history of kama`aina accounts of the area, historical survey of <br /> documentary records, or botanical study was included in the application. <br /> • The valued cultural, historical, and natural resources found in the rezoning area: <br /> The property has been previously bulldozed and cleared, and is currently in <br /> residential use. A condition of the change of zone will require that the applicants <br /> cease work and notify the SHPD should any unanticipated archaeological features <br /> or sites be uncovered during the course of development. <br />
