Tentative Subdivision Approval the same year. A final plat map and construction plans <br /> were submitted to Planning in May 2014 but the applicant was not able to secure final <br /> subdivision approval prior to the deadline. <br /> Condition J and 6-Condition J of the ordinance is identical to Condition No. b of the <br /> SMA permit, and states: <br /> "A drainage study shall be prepared for review and the recommended drainage <br /> system shall be constructed meeting with the approval of the Department of <br /> Public Works. The drainage improvements shall be constructed prior to receipt <br /> offinal subdivision approval." <br /> The condition currently requires that drainage improvements be constructed prior to <br /> receipt of Final Subdivision Approval.The applicant is requesting to amend these <br /> conditions in order to provide a surety bond for the drainage improvements so that Final <br /> Subdivision Approval can be issued before the improvements are constructed. Bonding <br /> of drainage improvements is a routine process similar to the bonding of other subdivision <br /> improvements. The applicant anticipates constructing the project's drainage <br /> improvements within six months of receipt of a grading permit from the Department of <br /> Public Works. <br /> Condition V-Condition V of the ordinance states: <br /> "The applicant shall pay its fair share contribution to address potential regional <br /> impacts of the project with respect to roads,park fire,police and solid waste <br /> disposal facilities. The fair share contribution shall be initially based on the <br /> representations contained within the change of zone application and may be <br /> increased or reduced proportionally if the lot counts are adjusted. The fair share <br /> contribution shall become due and payable prior to final subdivision approval of <br /> any portion of the subject property or within five (5)years from the effective date <br /> of this change of zone ordinance, whichever occurs first. The fair share <br /> contribution for each lot shall be based on a maximum density for each lot as <br /> -2- <br />
