Ordinance No.08-131 <br /> 1. Kona Community Development Plan(KCDP)adopted by Ordinance 08-131: <br /> The Transportation and Land Use section of the KCDP fall under Chapter 4(Goals,Policies, <br /> Objectives and Actions.) These sections refer to specific concurrency requirement within the Kona <br /> Urban Area(KUA). The KUA is comprised of Transit-Oriented Development Urban Villages <br /> (TODs)as well as Concurrency Zones. <br /> The proposed development lies within Concurrency Zone L and is subject to the following: <br /> "The legally binding policies in this section,as defined irn4.0 Goals,Objectives, Policies and Actions, <br /> do not override or invalidate existing zoning. Such legally binding policies, however, shall be <br /> implemented with new changes of zone, time extensions on existing zoning requiring County Council <br /> action, state land use boundary amendments, and Special Management Area(SMA)permits. <br /> Per Hawaii County Code Section 25-2-46, rezoning within the KUA shall comply with the Official <br /> Concurrency Map,which identifies the road segments to be constructed concurrent with occupancy of <br /> units as the minimum"area mitigation." <br /> The Official Concurrency Map assumes: <br /> • The widening of Queen Kaahumanu Highway to four lanes from the Kona International <br /> Airport to Henry Street. <br /> • Concurrency Zone L requires that the following roads be constructed before occupancy of <br /> units: <br /> o 30A—Kahului-Keauhou Parkway(Lako Street to Kuakini Highway) <br /> o 31 —Lako Street Extension <br /> The State of Hawaii Department of Transportation(DOT)has confirmed that the widening of Queen <br /> Kaahumanu Highway from the Kona International Airport to Henry Street will commence in September <br /> 2015 and take approximately 2 years to complete. Goodfellow Bros., Inc. has received Construction <br /> Notice to Proceed from the DOT. Completion of Queen Kaahumanu widening will coincide with the <br /> occupancy of the 58 single-family residential units slated to be constructed. <br /> Although Kahului-Keauhou Parkway and the Lako Street Extension are noted as priorities for <br /> construction,the proposed alignment of each was preliminary at the time the KCDP was finalized. <br /> Applicant respectfully asks to be excused from the requirement of Concurrency Zone L to construct the <br /> Kahalui-Keauhou Parkway as it has been indefinitely placed on hold due to the discovery of significant <br /> archeological findings. <br /> Per Kason Pacheco of the County of Hawaii Department of Public Works, a private developer of property <br /> surrounding the proposed Lako Street Extension has retained a consultant and working on a survey so as <br /> to begin civil design. The private developer expects construction to being within a year. <br /> 4 <br />
