Section 26-2-35. Application fees. <br /> (a) Licensees that plan to conduct business in the County shall pay the following fees for each <br /> license, pursuant to section 26-2-31: <br /> (1) $3,000 for each importer per year; <br /> (2) $2,000 for each wholesaler's site per year; <br /> (3) $1,000 for each permanent or temporary storage site per year; and <br /> (4) $500 for each retailer's site per year. <br /> (b) As used in this section, the term "year" shall pertain to the period beginning on April 1 of <br /> the year in which the license was issued to March 31 of the following year. <br /> (c) The nonrefundable fee for each license shall be made payable to the director of finance and <br /> shall be submitted to the department with the application. <br /> (d) The department shall provide an exemption from license fees to nonprofit community <br /> groups for importation and storage of fireworks or articles pyrotechnic for displays once a <br /> year. <br /> Section 26-2-36. Requirements of licensee. <br /> (a) Sale or transfer. <br /> (1) It shall be unlawful for any person, other than a wholesaler who is selling or <br /> transferring fireworks to a licensed retailer, to sell or offer to sell, exchange for <br /> consideration, give, transfer, or donate any fireworks, or articles pyrotechnic at any <br /> time to any person who does not present a permit duly issued as required by division <br /> 4 (Permits). <br /> (2) The permit shall be signed by the seller or transferor at the time of sale or transfer of <br /> the fireworks, and the seller or transferor shall indicate on the permit the amount and <br /> type of fireworks sold or transferred. <br /> (3) No fireworks shall be sold or delivered to any permittee in any amount in excess of <br /> the amount specified in the permit. <br /> (4) No fireworks shall be sold to a permittee holding a permit issued for purposes of <br /> sections 26-2-42 through 26-2-44, more than five calendar days prior to the <br /> designated periods for use as set forth in sections 26-2-42 through 26-2-44. <br /> (b) Structures, buildings, and facilities. <br /> Structures, buildings, and facilities where fireworks are stored or redistribution activities <br /> are performed shall comply with County, State, and National building and fire codes. <br /> 8 <br />
