Hawai i <br />TIME: 1:05 p.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Your Committee on Planning, to which was referred Bill No. 10, reports as follows: <br />Bill No. 10, transmitted by Mayor Harry Kim, via Communication No. 81 dated January 18, <br />2017, amends Ordinance No. 12-111 which amended Ordinance No. 99-116 which amended <br />Ordinance No. 96-159 which amended section 25-8-33 (City of Hilo Zone Map), Article 8, <br />Chapter 25 (Zoning Code) of the Hawaii County Code 1983 (2016 edition, as amended) <br />(formerly referred to as Section 25-114, City of Hilo Zone Map, Article 3, Chapter 25, Zoning <br />Code), by changing the District Classification from Single Family Residential — 10,000 square <br />feet (RS -10) to Neighborhood Commercial — 7,500 square feet (CN -7.5) at Waiakea, South Hilo, <br />Hawaii. covered by tax map keys: 2-2-044:003, 031 032, 035, and 037. <br />The Windward Planning Commission recommended approval of this bill at its public hearing on <br />January 5, 2017. for an amendment to Change of Zone Ordinance No. 12-111, which would: <br />1) Grant a time extension to secure final subdivision approval; 2) Modify the timing of installing <br />drainage improvements; and 3) Reduce the fair share contribution provision for this assisted <br />living facility. <br />This measure is initiated by the applicant, Rhodes Moore, LLC—formerly Graphic Images <br />Hawaii, Inc.—for property located on the southeast side of the intersection of Kanoelehua <br />Avenue and Fast Kahaopea Street, Waiakea Homestead I louse Lots, South Hilo, Hawaii, and <br />the subject area is 322,414 square feet. <br />Phomas Yeh, Esq., attorney for the applicant and Mr. John Dewalt, principal, developer and <br />representative of Rhodes Moore LLC, came forward to provide information and answer <br />questions. Mr. Yeh stated that they had discussions regarding the flooding challenges on this <br />property with the adjoining land owners Russell Doi and Stephanie Salazar. Mr. Yeh explained <br />that the applicants are not allowed to change the flow of water in terms of velocity, location, <br />width or depth from where it exits the property. He also said that the Federal Emergency <br />Management Agency (FEMA), County Code nor common law allows the flow of water to be <br />changed. Ile said that they are making adjustments, therefore they are asking for a five year <br />time extension from August of 2017 to complete these improvements, prior to a certificate of <br />occupancy being issued. He further added that they will be providing a possible emergency <br />access road for the adjoining land owner in the event that the main common driveway has water. <br />PC Report No. 5 <br />
