WHEREAS, Article X, Section 10-11 of the County Charter requires that any contract, lease or other obligation requiring payment of funds from the appropriations of a later fiscal year or more than one fiscal year be approved by resolution; and NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that in accordance with Article X, Section 10-11 of the Hawai`i County Charter, the Mayor is hereby authorized to enter into one or more ten (10) year contracts, with two five (5) year renewal options, for services of furnishing and implementing green waste collection sites in West Hawai`i and/or East Hawai`i for the Department of Environmental Management and that sufficient funds be budgeted in future fiscal years to cover the anticipated obligation of the County under the terms of the agreement. The agreement shall include an in-vessel composting component; may include an additional one (1) year to the initial term for site preparation, mobilization and demobilization; and provide that all on-site improvements shall belong to the County upon the expiration of the contract period. BE IT FURTHER RESOLVED that this authorization shall remain in effect for fifteen (15) months from the adoption of this resolution. BE IT FINALLY RESOLVED that the County Clerk shall forward a copy of this resolution to the Mayor, the Director of Environmental Management and the Director of Finance.
