other projects in the nearby vicinity, the USFWS stated that the endangered Hawaiian <br /> Hawk and Hawaiian Hoary Bat have been observed in the vicinity of the proposed <br /> project. In addition, the endangered Hawaiian Petrel, the threatened Newell's shearwater <br /> and the band-rumped storm petrel may transit the project area. In those previous cases, <br /> the USFWS recommended mitigation measures to avoid and minimize project impacts to <br /> the listed species. According to USFWS, "potential impacts to seabirds can be <br /> minimized by: 1) shielding outdoor lights associated with the project, particularly when <br /> used during each year's peak fledging period (September 15 through December 15); <br /> 2) avoiding night-time construction; and 3)providing all project staff with information <br /> regarding seabird fallout. <br /> 20. Archaeological/Historical Resources:' In a letter dated March 13, 2018, the Department <br /> of Land and Natural Resources - State Historic Preservation Division (DLNR-SHPD) <br /> determined no historic properties will be affected by the proposed rezone because the <br /> property has been subject to previous agricultural uses. <br /> 21. Cultural or Native Gathering Rights: According to the applicant, there is no evidence <br /> of any traditional and customary Native Hawaiian rights being practiced on the site, nor <br /> existence of any known valued cultural, historical or native resources in the area. <br /> 22. Public Access: There is no record of a designated public access to the shoreline or <br /> mountain areas that traverses the subject property. <br /> 23. Scenic and Visual Resources: The proposed change of zone and the subsequent <br /> subdivision are not anticipated to change the visual attributes of the existing views of the <br /> ocean from North Wilder Road or from Akolea Road. The views of Mauna Kea and <br /> Mauna Loa from Kaumana Drive will not be affected. The property is not listed as a <br /> distinctive and identifiable landmark as identified in the Hawai`i County General Plan. <br /> 24. Streams and Other Waterways: There are no known streams that traverse the subject <br /> properties. The nearest stream is the non-perennial Kaluiiki tributary from the Wailoa <br /> River, which is about 329 feet to the north and flows down towards the east (away from <br /> the subject properties). Any project and its potential impacts to State waters must meet <br /> State and Federal rules and regulations. <br /> -5- <br />
