WHEREAS, the Department of Public Works, Planning Department, Department of Environmental Management, and Finance Department have concurred with Waimea Wastewater's request for a grant of sewer easement across the roadway; and WHEREAS, this easement is designated Easement S-41, consisting of approximately 860 square feet, as described on Exhibit "A" and delineated on Exhibit "B", both of which are attached hereto and incorporated herein; and WHEREAS, pursuant to Section 2-111(2), Hawai`i County Code, the Council is authorized to direct the Director for the Department of Public Works to grant easements for particular purposes, subject to reversion to the County of Hawai`i upon termination or abandonment of the specific purpose for which it was granted. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, that the Director for the Department of Public Works is hereby authorized to grant the non-exclusive easement on, through, and/or over that certain segment of roadway identified as a portion of Kaomoloa Road, identified as Tax Map Key No.: (3) 6-7-003 (portion of Kaomoloa Road,Lot R-1), with said easement designated as Easement S-41 consisting of approximately 860 square feet, as described on Exhibit "A" and delineated on Exhibit "B", pursuant to Chapter 2, Article 19, Hawai`i County Code, for use as a sewer easement and that such grant of easement is subject to reversion to the County of Hawai`i upon its termination or abandonment of the specific purpose for which said easement was granted. BE IT FURTHER RESOLVED that the County Clerk shall transmit copies of this resolution to (1) Mayor Harry Kim; (2) Deanna Sako, Director of Finance; (3) Allan Simeon, Director of Public Works; (4) Deputy Corporation Counsel Ronald Kim; and(5) Waimea Wastewater Company, Inc., 66-1304 Mamalahoa Highway, Kamuela HI 96743. 2
