Valued Cultural Resources <br /> In view of the recent Hawaii State Supreme Court's "PASH" and "Ka <br /> Pa'akai 0 Ka'Aina decisions, the issue relative to native Hawaiian <br /> gathering and fishing rights must be addressed. Specifically, there <br /> must be a discussion on the cultural, historical and natural resources, <br /> as well as the associated tradition and customary practices of this site. <br /> In this situation, the subject site is not and/or proximate to the <br /> J adjacent <br /> shoreline. As such, gathering of marine life and coastal access is not <br /> an issue. <br /> It is not known whether the subject or immediate surrounding area <br /> was used in the recent past for the gathering of plants by Native <br /> Hawaiians. The applicants have not observed any Native Hawaiians <br /> gathering plants on the site or the adjoining properties. Thus, it would <br /> appear unlikely that the site would serve such purpose today. <br /> In the event that legitimate gathering claims are made by Native <br /> Hawaiians, the applicants intend to respect and honor such claims <br /> and provide the legal and needed access within the site. <br /> Based on the above, it does not appear that the project would have <br /> any potential adverse impact relative to the cultural and historical <br /> resources of the area. <br /> H. Water and Coastal Resources <br /> The subject site is located approximately 0.75 miles from the coastline <br /> at a 830 foot +/- elevation. As such, coastal impacts resulting from <br /> discharge of wastewater systems from the site should not be <br /> 9 <br />
