While we progressed towards transitioning from the design and documentation phase with relative ease, we <br /> encountered unforeseen and unanticipated rise in construction cost increases during the second quarter of 2015, due <br /> to in part, the exponential cost increases attributed to economic growth and increasing market values for <br /> construction materials and labor. The resulting in competitive bid prices exceeded that of the anticipated design goal <br /> and available finances of the owner. Upon review of bids and consulting with the owner and her financial institution, <br /> we made the strategic decision to place the project on hold while we worked General Contractor who presented the <br /> lowest bid price, to value engineer the entire project while our client sought additional finance options from all <br /> available funding sources. United by the belief in the benefits presented by this project to our community, our client, <br /> the Architect (KOA) and the Contractor worked to maintain the design intent integrity as expressed, while actively <br /> reducing costs where possible. The Owner and the Contractor formally executed a General Construction contract <br /> December 30, 2016 and construction commenced March of 2017. Current contractual date of Final completion is June <br /> 2018. <br /> As of the date of this letter, our client is presently and has been undertaking substantial efforts to comply with the <br /> performance conditions as approved by the Use Permit (13-000042) and Change of Zone Ordinance (07 166). Currently <br /> the building envelope is roughly 80% complete. As we continue to work in earnest to facilitate construction <br /> administration on all fronts, it is apparent we have not been able to complete the construction of the new Medical <br /> Office Building for Hawaii Family Health as established within Ordinance No. 07 166, Condition 'C' and Use Permit No. <br /> 13-000042, Condition No. 4. <br /> Hawaii Family Health's mission is to provide quality health care services to our community. The project will provide <br /> HFH with a new, substantially larger facility than the current Ululani St. location (repurposed residential structure) <br /> well as two (2) additional medical office tenant spaces. We fully support and believe in our client's mission to provide <br /> quality health care services to our community which is currently underserved and with respect to healthcare <br /> professionals. Our client has worked diligently and tirelessly to see this project through. We sincerely request the <br /> consideration from the Planning Director, Planning Commission and the County Council to extend the for the <br /> construction completion deadline an additional 5 years, or what the County Council deems a reasonable amount of <br /> time to complete the construction as permitted and granted per Ordinance No. 07 166 and Use Permit No. 12-000042. <br /> As we await further instruction from the Planning Dept, we continue to move towards completion and humbly request <br /> time extension from the current compliance deadline (10-02-17) to complete the construction of the Medical Office <br /> Building well before an additional 5-year construction completion deadline. <br /> Respectfully, <br /> Merrick F. This time <br /> period shall include securing Final Plan Approval from the Planning Director in accordance with the Zoning Code. Plans shall <br /> identify proposed structures, fire protection measures, access roadway, driveway and parking stalls. Plans shall also identify the <br /> drainage easements ("D-6" and "D-7"), as well as the portion of the property designated Flood Zone "A"by the Flood Insurance <br /> Rate Map (0880C September 16, 1988). Landscaping shall be indicated on the plans for the purpose of mitigating any potential <br /> adverse noise or visual impacts to adjoining parcels. Landscaping shall be provided in accordance with the requirements of <br /> Planning Department's Rule No. 17 (landscaping Requirements). <br /> Use Permit 13-000042 <br /> Condition No. 4: Construction of the medical clinic shall be completed on or before November 2, 2017 as required by Condition C <br /> of Change of Zone Ordinance No. 07-166. Prior to commencing construction, the applicant, successor(s)or assign(s)shall secure <br /> Final Plan Approval for the proposed development from the Planning Director in accordance with Section 25-2-70, Chapter 25 <br /> (Zoning code), Hawaii County Code. Plans shall identify all proposed structure(s), paved driveway access and paved parking stalls <br /> associated with the proposed development. Landscaping shall be indicated on the plans for the purpose of mitigating any adverse <br /> noise or visual impacts to adjacent properties in accordance with the requirements of the Planning Department's Rule No. 17 <br /> (Landscaping Requirements)and Chapter 25 (Zoning Code), Hawaii County Code. Landscaping shall comply with the landscaping <br /> requirements for a CN (Neighborhood Commercial)zone in Rule No. 17. <br />
