Poindexter, Council Chair <br /> and Members of the County Council <br /> Page 3 <br /> Thus, the applicant has been working towards compliance with the conditions of the <br /> change of zone ordinance and non-performance is the result of conditions that could not <br /> have been foreseen and were beyond the control of the applicant <br /> Approval of this request would not be contrary to the General Plan or Zoning <br /> Code nor the original reasons for granting the Change of Zone. The original reasons <br /> for the approval of the change of zone are still applicable, and the request is not contrary to <br /> these reasons. The zoning was originally approved in 2007 to provide additional land for <br /> multiple-family land uses in Hilo in close proximity to existing services. The applicant is <br /> currently constructing a medical clinic and related improvements, which the Planning <br /> Commission granted in 2013 as Use Permit No. 13-000042. The Public Facilities-Health <br /> and Sanitation Element of the General Plan encourages the establishment or expansion of <br /> community health centers and rural health clinics. The proposed medical clinic, whose <br /> mission is to provide quality health care services to our community, will fulfill this need in <br /> the community, and therefore is consistent with the General Plan. <br /> The applicant is seeking additional time to complete construction of the medical <br /> facility and related improvements. The Planning Department is supportive of the request <br /> for a time extension to complete construction as the applicant has been consistently <br /> working towards meeting the conditions of approval. <br /> In a July 10, 2013 memo, the DPW-Engineering Division stated that a portion of <br /> the subject property is in an area designated as Flood Zone A on the Flood Insurance Rate <br /> Map (FIRM) by the Federal Emergency Management Agency(FEMA). Flood Zone A is <br /> the Special Flood Hazard Area inundated by the 100-year flood where no base flood <br /> elevations are determined. However, the drainage easement "D-6" designation accurately <br /> defines the flood inundation area. In an April 13, 2018 memo, DPW-Engineering Division <br /> stated that they have no objection to a time extension to complete construction. <br /> In the immediate area are a mix of agricultural and commercial land uses. Located <br /> at the northeast corner of the Ponahawai and Komohana Streets intersection is the Ka <br /> Waena Lapa'au medical office complex. The adjacent parcel to the east and south is <br /> commercially zoned, and is vacant of any structures or improvements. The adjacent parcel <br /> to the west is agriculturally zoned, and vacant of any structures or improvements. <br />
