Recent nearby ordinances that <br /> changed the district from agricultural to neighborhood commercial include Change of Zone <br /> Ordinance No. 10 045 for TMK: (3) 2-3-037:006 and Change of Zone Ordinance <br /> No. 15 002 for TMK: (3) 2-3-037:012. <br /> There was no formal flora/fauna study conducted for this time extension request. <br /> Due to previous grading and grubbing in the area, the applicant indicated that it is unlikely <br /> that any threatened or endangered flora or fauna species are present on the property. At the <br /> time of this writing, the U.S. Fish and Wildlife (USFWS) has not provided comments on <br /> the subject project. However, for other projects nearby, the USFWS commented that the <br /> endangered Hawaiian Hawk and Hawaiian Hoary Bat have been observed in the vicinity of <br /> the proposed project. In addition, the endangered Hawaiian Petrel, the threatened Newell's <br /> shearwater and the band-rumped storm petrel may transit the project area. In those <br /> projects, the USFWS recommended mitigation measures to avoid and minimize project <br /> impacts to the listed species. According to USFWS, "potential impacts to seabirds can be <br /> minimized by: 1) shielding outdoor lights associated with the project, particularly when <br /> used during each year's peak fledging period (September 15 through December 15); <br /> 2) avoiding night-time construction; and 3) providing all project staff with information <br /> regarding seabird fallout. The Planning Director recommends adding a condition to <br /> address outdoor lights and avoiding night-time construction in order to mitigate impacts on <br /> these known endangered species. <br /> The Planning Director recommends updating Condition M relating to historic sites <br /> and Condition 0 relating to fair share to reflect the current standard language for <br /> conditions of approval, as well as deleting the requirement for a Plan Approval since the <br /> applicant secured Final Plan Approval in 2014 for the medical facility. <br /> The County Council adopted concurrency requirements for water, roads and civil <br /> defense sirens. County water is available to the site. The Department of Water Supply <br /> (DWS) stated that they do not object to the subject time extension request and that their <br /> comments in a November 22, 2017 letter still stands. The Planning Director recommends <br /> updating the condition language to reflect that the applicant shall maintain the water <br /> commitments obtained from the Department of Water Supply, as required. <br /> The Zoning Code concurrency section requires a Traffic Impact Analysis Report <br /> (TIAR) whenever a proposed development will generate over 50 peak hour trips. As this <br /> amendment request is for a 5-year time extension to complete construction and no <br />
