Condition H <br /> of Ordinance No. 07 166 states that the applicant shall install street lights and traffic <br /> control as the DPW-Traffic Division may require. This condition will remain. <br /> standards for civil defense sirens are met bytwo (2) existingcivil <br /> Concurrency <br /> defense sirens within range of the subject property, one at Gilbert Carvalho Park and the <br /> other at the Mohouli Park. Therefore, there is no requirement for the applicant to install <br /> any additional civil defense sirens for this amendment request. The proposed request will <br /> not unreasonably burden public agencies to provide infrastructure and utilities to the <br /> property. <br /> During the review of this application, our office sought comments from other <br /> government offices to understand how their rules and regulations will impact the <br /> amendment request. To ensure compliance with their regulations, their comments are <br /> conditions of the attached recommendation. On the record and if deemed necessary, the <br /> Planning Commission may suggest adding, modifying or deleting a portion or all of the <br /> language for any of the conditions attached to this recommendation report. The Planning <br /> Commission's recommendation will go to the County Council as the final authority who <br /> may grant this amendment for a Change of Zone Ordinance. <br /> Lastly, this recommendation is made with the understanding that the applicant <br /> remains responsible for complying with all other applicable County, State and Federal <br /> governmental requirements in connection with the approved use,prior to and during its <br /> commencement or establishment upon the subject property. Additional governmental <br /> requirements may include the issuance of building permits, the installation of approved <br /> wastewater disposal systems, compliance with the Fire Code, installation of improvements <br /> required by the American with Disabilities Act (ADA), compliance with State Health <br /> Department environmental/sanitation/health-related regulations, drainage plan, among <br /> many others. Compliance with all applicable governmental requirements is a condition of <br /> this approval, and failure to comply with such requirements will be considered a violation <br /> that may result in enforcement action by the Planning Department and/or the affected <br /> agencies. <br /> Based on the preceding, the Planning Director recommends that a favorable <br /> recommendation be forwarded to the County Council to amend Ordinance No. 07 166.
