The applicant requests that the subject condition is amended <br />follows: <br />Prior to the issuance of a Certificate of Occupancy for improvements within an <br />approximately 48.4 -acre [44 -acre -e] portion of Parcel I (Initial Project Area) along <br />Kanalani Street Extension between the north property boundary and the vicini o <br />South [ h] Access Road, Kanalani Street Extension from the north property <br />boundary to the vicinity of South [Ner4] Access Road and the construction of <br />improvements within the South and North Access Roads between [/] Queen <br />Kaahumanu Highway [M t,,rs,,. do J and the Kanalani Street Extension [A[6 l <br />^ee„s-s Read], as provided in the TZAR, shall be completed to County dedicable <br />standards. The Initial Project Area shall not exceed 711, 000 square feet of gross <br />leasable commercial area or its equivalent if industrial land uses are developed <br />tinder the MCX zoning. * <br />The applicant is not an active developer of the property and has been seeking third <br />party(ies) to undertake the active development of the WHBP through the sale of some or all <br />of the project area since 2008 with no success. The applicant believes that the upfront <br />roadway improvement requirements (Kamanu Street Extension and connection between <br />Kamanu Street and Queen Ka`ahumanu Highway) are too cost prohibitive to effectively <br />market/develop the property. The proposed amendment would provide for the <br />sale/development of a significant portion of the WHBP, which would then provide <br />financial resources for the construction of the Kainanu Street extension improvements. <br />Additionally, the applicant believes that due to alternative regional transportation facilities <br />being completed in the area since 2004 (e.g. Ane Keohokalole Highway between Palam <br />Road and Hina Lani Street and Queen Ka`ahumanu Highway widening project), the <br />immediate improvement of the Kamanu Street extension is no longer necessary to provide <br />a solution to the regional traffic circulation needs. Finally, approval of the proposed <br />amendment will require that Kanalani Street be constructed from the existing Kanalani <br />Street terminus in the Kaloko Light Industrial area to the WHBP South Access Road, <br />instead of just to the future North Access Road as currently required. These improvements <br />will allow a second access to the area thereby reducing congestion at the Kanalani <br />* The proposed Condition K amendment language evolved from the original application to the time of this writing <br />based on agency comments. The proposed condition language in this background report reflects the final requested <br />amendment language. <br />
