or penalties assessed in relation to operation of the STVR, 3) the owner or <br /> reachable person has not been reachable, and 4) if there have been police reports <br /> or verified neighbor complaints of noise or other disturbance. The Director must <br /> deny renewal of a certificate if the use has been abandoned for any reason for a <br /> continuous period of twelve calendar months. <br /> 14. The Director must provide the decision to deny renewal of a certificate in writing <br /> and the owner may appeal the decision to the County Board of Appeals within 30 <br /> days of receipt of the decision. <br /> LOSS OF NONCONFROMING STVR's DUE TO EMERGENCY <br /> 15. The bill also includes a provision that requires the Director to assess the effect of <br /> the permanent loss of nonconforming STVR's when a declared emergency <br /> occurs, such as lava inundation. The Director can initiate legislative and <br /> administrative opportunities to restore losses in STVR capacity within the <br /> affected district. <br /> STANDARDS FOR OPERATION OF A STVR <br /> 16. The bill requires that all STVR's have an owner or `reachable' person that resides <br /> within the County.This person must be reachable by guests, neighbors and the <br /> County agencies on a 24 hour/7 days a week basis. The bill defines `reachable' as <br /> being able to respond via telephone to a request for his/her presence within 1 hour <br /> of receiving the request and being physically present at the STVR within 3 hours <br /> of receiving a call from a guest, neighbor, or County agency. The owner must <br /> notify the Department of any changes to the contact information for the <br /> `reachable' person. <br /> 17. All STVR's must abide by a good neighbor policy,which requires the owner or <br /> reachable person to make sure the activities taking place in the STVR conform to <br /> the character of the surrounding neighborhood. The policy must be displayed on <br /> the premises and included in the rental agreement. The policy includes: quiet <br /> hours from 9:00 p.m. to 8:00 a.m.; ensuring that sounds outside of quiet hours do <br /> not exceed what is normal for a residential area,prohibiting machines or devices <br /> that generate loud sounds, and ensuring that guests park onsite in designated <br /> parking areas. <br /> -5- <br />
