18. Other standards that all STVR's must abide by include: <br /> • Displaying on the back of the door of the sleeping quarters, a copy of the <br /> registration or nonconforming use certificate and the reachable person's name <br /> and phone number. <br /> • Including the registration number or nonconforming use certificate number on <br /> all forms of advertising of the STVR. <br /> • Complying with the Sign Code and parking requirements for STVR's. <br /> COMPLAINTS AND ENFORCEMENT <br /> 19. The bill requires the Director to receive and track complaints regarding STVR's, <br /> and provide information about STVR rules,policies and procedures to property <br /> owners, managers, neighbors, and the general public. The Director is also <br /> responsible for adopting rules of practice and procedure to implement the <br /> provisions of the bill. <br /> 20. To enforce the provisions of this bill,the inspectors will be able to rely on any <br /> advertising offering the property as a short-term vacation rental as evidence that a <br /> STVR is operating on the property. The burden of proof will be on the owner to <br /> establish that the STVR is being operated legally or the property is not being used <br /> as a STVR. <br /> 21. The bill proposes to establish a short-term vacation rental enforcement account <br /> administered by the Planning Director, for the purpose of enforcing this proposed <br /> short-term vacation rental law. The account will be funded by fees collected for <br /> registration of STVR's, fees collected for renewal of nonconforming use <br /> certificates, and fines collected from enforcement actions. <br /> PLANNING ANALYSIS OF THE IMPACTS OF BILL 108,DRAFT 4 <br /> In many communities across the country and state, new laws are being <br /> implemented to regulate vacation rentals for various reasons such as competition with <br /> hotels, removal of housing stock for long-term rentals, and negative impacts on <br /> surrounding neighborhoods. According to the Hawai`i Tourism Authority's 2015 Visitor <br /> Plant Inventory,these types of rentals may be fulfilling segments of market demand that <br /> have been underserved by Hawai`i's traditional visitor accommodations.These include <br /> the market for lower-priced accommodations and demand for accommodations in parts of <br /> -6- <br /> 1 <br />
