The applicant shall implement, when <br /> required by the Department of Public Works, at no cost to the County, any <br /> transportation system improvements to Kilauea Avenue that may be deemed <br /> necessary by the Department of Public Works." <br /> The Planning Director recommends a condition to address traffic impacts should the use <br /> generate over 50 peak hour trips. If granted, the request will allow the completion of <br /> construction within five (5) years of the effective date of this amended Ordinance, with the <br /> possibility of an administrative time extension of an additional five (5) years, for a <br /> maximum of ten (10)years to complete construction. The proposed project consists of <br /> converting two (2) existing single-family dwellings into office spaces, with the potential of <br /> demolishing them and constructing a new commercial building on the subject site. This <br /> project consists of three adjacent parcels, totaling 28,002 square feet. In the original request, <br /> the applicant submitted a site plan depicting the following: <br /> • Proposed conversion of an existing 1,288-square foot single-family dwelling with an <br /> existing carport into office space on TMK: (3) 2-2-028:030. The land size is <br /> 13,906 square feet. <br /> • Proposed conversion of an existing 1,312-square foot single-family dwelling with an <br /> existing carport into office space on TMK: (3) 2-2-028:032. The land size is <br /> 12,416 square feet. <br /> • Nine (9) proposed onsite parking stalls. <br /> • The existing 1,680-square foot roadway lot, known as TMK: (3) 2-2-028:033, will <br /> continue to provide road and utility access to parcels 30 and 32. <br /> The non-performance is the result of conditions that could not have been <br /> foreseen or are beyond the control of the applicant, successors or assigns, and that are <br /> not the result of their fault or negligence. The effective date of Ordinance No. 06 47 was <br /> April 12, 2006, which required completion of construction within one year or by <br /> April 12, 2007. The granted administrative time extension gave an additional year, <br /> or by April 12, 2008. Several factors affected the ability and focus of the applicant to <br /> develop the property, as the applicant and her parents were to develop this project together. <br /> However, a death in the family shortly after the approval of the original Change of Zone <br />
