Y • <br /> BACKGROUND INFORMATION <br /> 7. County Council Resolution No. 330 96: On June 19, 1996, the County Council adopted <br /> Resolution No. 330 96 relating to the amendment of zone district boundaries within <br /> Kaloko Mauka and other Kona Watershed and Mauka Forest Areas. The resolution states <br /> that no lands above the 3,000-foot elevation within the Kaloko Mauka Subdivision or the <br /> 3,700-foot elevation above sea level elsewhere in the districts of North Kona and South <br /> Kona shall be re-classified to any zone district having a minimum lot size of less than 20 <br /> acres except where contiguous lands held under the same or a cooperative ownership are <br /> concurrently placed in a lower density zoned district with a net effect of maintaining or <br /> reducing overall density levels and enhancing the integrity and value of the region's <br /> watershed and forest systems. <br /> 8. County Council Resolution No. 58 97: On June 2, 1997 the County Council adopted <br /> Resolution No. 58 97, amending the Council's policy relating to the rezoning of district <br /> boundaries within Kaloko Mauka Subdivision. The Council established that a maximum <br /> density of two dwellings per twenty acres for lands within the Kaloko Mauka Subdivision <br /> above the 3,000-foot elevation, with certain conditions, will protect the watershed and <br /> native forest and maintain a low density pattern. The Resolution further recommended <br /> that the Planning Commission consider favorable recommendations for A-10a zoning <br /> requests for only those parcels within the Kaloko Mauka Subdivision above the 3,000- <br /> foot elevation and include the conditions as stated within Resolution No. 58 97, provided <br /> that the request complies with the other goals, policies, and standards of the General Plan. <br /> 9. Change of Zone Ordinance No. 05 66: Change of Zone Ordinance No. 05 66 was <br /> approved on May 16, 2005, which reclassified 20.254 acres of land from an Agricultural <br /> (A-20a) to an Agricultural (A-10a) zoning district for TMK: 7-3-027:007. Condition D <br /> required that Final Subdivision Approval be secured within 5 years from the effective <br /> date of the ordinance (May 16, 2010). The applicants received an administrative time <br /> extension to comply with Condition D until May 16, 2015. <br /> 10. Subdivision 05-000136: The applicants submitted a subdivision application on <br /> July 20, 2005 for a two-lot subdivision. The subdivision was withdrawn on <br /> September 2, 2014 by request of the applicants. <br /> -2- <br />
