a <br />COUNTY OF HAWAII <br />RESOLUTION NO. <br />STATE OF HAWAI `I <br />im <br />RESOLUTION AUTHORIZING THE DEPARTMENT OF PARKS AND <br />RECREATION TO AWARD FUNDS TO PEOPLES ADVOCACY FOR <br />TRAILS HAWAII <br />WHEREAS, Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County <br />Code (2005 Edition as amended) states that grant awards in excess of $25,000 to <br />nonprofit organizations shall specifically identify the organization receiving the grant <br />funds and the purpose for which the grant funds shall be used in an ordinance or <br />resolution.; and <br />WHEREAS, Chapter 2, Article 25, Section 2-136(5) of the Hawaii County Code <br />states, "nonprofit organization" means an organization organized for other than profit- <br />making purposes and which has a current 501(c)3 tax -exemption from the Internal <br />Revenue Code; and <br />WHEREAS, the Department of Parks and Recreation wishes to provide $30,000 <br />to Peoples Advocacy for Trails Hawaii; and <br />WHEREAS, Peoples Advocacy for Trails Hawaii qualifies as a nonprofit <br />organization as defined above and shall use grant funds to expand the bike -share <br />program in Kona from three (3) stations to six (6) stations; and <br />BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII, in <br />accordance with Chapter 2, Article 25, Section 2-139(a)(3)(A) of the Hawaii County <br />Code, the Department of Parks and Recreation is authorized to provide a grant of <br />$30,000 to the Peoples Advocacy for Trails Hawai'i to expand the bike share program in <br />Kona as indicated above. <br />
